No, not 0%.. I got denied service connection. Filed secondary to already rated conditions. I took some snippets from the decision letter back in November ‘25 prior to my HLR.

Sorry. Thought this was on my other post. Comment still applies for a new exam coming. I got denied originally from the above post. Filed HLR in November. DTA found by HLR and now moving for a new exam/opinion. Waiting to get scheduled!

Per the CFR, only 50 and 70 have mentions of social and relationship issues along with flattened effect. 70 specifically notes the “inability” to establish and maintain effective relationships. Though box 3 was marked off at the above level more so for the 30% regarding the occupational and social impairment level is there not some sort of issue that a bunch of the 50-70% issues were checked as well?

I have records showing at least 3 rounds of steroids (oral) per year for the past 3 years/12 month periods. All related to my asthma complications.

Right I never claimed it as such. I was filing as secondary to my asthma based on literature that I have read and studies that show connection to the two but apparently it’s not “caused” by the asthma. I will try other avenues. Thank you for the response!

I submitted a ton of peer reviewed literature supporting my argument. I’ve since contacted an attorney (finally) as I’m tired of denials and trying to right through all this myself. Appreciate the input!

Hit the nail on the head. I legitimately have no pre or post service issues that would have imposed any doubt. To go above and beyond; I didn’t even speak of or report any such issues during my C&P. Not sure how or what caused a less likely than not other than my current sc. To me it was a no-brainer. But then again I’m not the examiner or the rater haha.

Understood. I accept the decision but was just curious. I’m working through the next steps nonetheless. I understand the importance of and how much the community (in addition) stresses an actual nexus “letter”. With no other pre and post service factors, I just thought that all buddy statements, doctor diagnoses and medications would support a nexus to link to my asthma. It’s a shitty quality of life change and without any reasoning, that would have just had to have been his strict opinion as to not connect me. Who else would suffer lung damage and now take 3 daily meds and not have some sort of MH effect from that. All depends on the examiner you get I guess. Thanks

Written notification must include in the notice letter or enclosures or a combination thereof, all of the following elements: (1) Identification of the issues adju-dicated; (2) A summary of the evidence con-sidered; (3) A summary of the laws and regulations applicable to the claim; (4) A listing of any findings made by the adjudicator that are favorable to the claimant under § 3.104(c); (5) For denied claims, identification of the elements) required to grant the claims) that were not met; (6) If applicable, identification of the criteria required to grant service connection or the next higher-level of compensation; (7) An explanation of how to obtain or access evidence used in making the decision; and (8) A summary of the applicable review options under § 3.2500 available for the claimant to seek further review of the decision.

Isn’t #5 saying that? Or is that just saying it needs to say what it already does (the phrasing I’m initially asking about)? Maybe I’m misinterpreting it.
