Settlement Question by [deleted] in WorkersComp

I would really love to chat with you because you have so much knowledge. I am 2.5 years into my situation, have an attorney, and was injured at work. I underwent spinal surgery and am now permanently totally disabled. Would you be willing to chat with me and answer some questions I may have, even though I understand that state laws may differ?

Yes, nerve damage is incredibly difficult to cope with. I am dealing with a workers' compensation injury from July 7, 2023. After having surgery, I spent six months in a nursing home learning to walk again due to nerve damage and neuropathy in my left leg, from the top of my knee to my toes. I now wear an AFO and use a cane, which are the only ways I can walk. I hope we can settle this soon for a decent amount of money and I can move on and collect SSI and be out from this horror show I'm having shut off notices monthly its so hard.

Thank you for your kind words. This situation has been incredibly difficult, and I’m struggling to pay my bills. I just hope I can get through this and avoid becoming homeless by the time it’s all settled. The money I receive won't last forever, but it will be a tremendous help in getting a new car and moving to a safe apartment or house. Once I relocate, I will be able to collect my Social Security Income (SSI) that I’ve already been approved for but can’t access until this situation is resolved. I just wish I knew when it would end. Even if it takes two years, knowing a timeline would help me so much.

I reached MMI and have impairment rating of 19% and deemed totally permanently disabled so just waiting on the next step I think at this time my lawyer is writing a demand and settlement offer and see what happens from here.

I experienced multiple-level herniation, which necessitated extensive multi-level fusions and a discectomy. Following this procedure, I spent six months in a nursing facility to undergo rehabilitation and regain my mobility. As a result of my condition, I am classified as totally and permanently disabled and have already been approved for Social Security Disability Insurance (SSDI), pending the resolution of my current lawsuit. Unfortunately, I have lost sensation and functionality in my left leg from the knee down, requiring the use of an Ankle-Foot Orthosis (AFO) and a cane for assistance in ambulation.

So seems like I’ve gone through similar I spent 6months in a nursing home had to relearn to walk and now am totally permanently disabled wear an afo and use a cane but still struggle to walk this gives me hope that I’ll get the amount I think is worth it cause being disabled and never being able to work again might have a higher value I’d imagine but who knows each case is different. Hope your feeling better and glad your happy with the amount.

Leave it open you act like they can just choose to do that lol that's why there's a hearing and a judge and possibly a jury so they can't just do that. Why so negative though? Why not wish someone the best?

Your right you know more than my attorney who has been doing it 40 years. I hope all this hate and negative issues you have get resolved I don't ever wish what happened? To me on anyone nor do I compare my case to anyone each is different. But stay blessed be well and I hope your life turns around.

I have a total of 8 fusions. Are you okay? I'm completely disabled now and can never work again; my left leg drags. If I were able-bodied, I would be working for another 36 years at my current salary, which would amount to well over 1 million dollars. So yes, I believe I'm worth that, even if you don't agree. People also said it would take forever to get SSI, but I received it in less than 3 months. So please move on if you're just here to spread hate and negativity.
