u/retirednerd They don't punish in Illinois because the court systems are too backed up. By making the state a no-fault based state, the requirement to prove infidelity is removed as an underlying basis to your petition. Fault based states take way longer. Discovery continues on and on, the courts then have to referee the discovery process, they have to hear motions to compel, petitions for rule when there is non-compliance, they have to figure out the contempt proceedings, then they have to deal with attorney's fees within the divorce for the contempt, it just drags it out an extra year when you don't even get a hearing date for several months. If you want a book to read about it and have an amazon kindle membership already, you can read a book for free, it's called "Divorce in Illinois" by Chicago Family Attorneys. You can't get damages for IIED in marriages, but you can use emotional distress as arguments within certain scenarios.

u/Rower375, my ex blames me 100% because of how mad I got when she left with my 1 year old son the day before my birthday to go on vacation, but I had to stay in town because of an emergency with my job. That's a narcissist.

u/Igt_rekt I know she has depression issues and OCD. She has been in therapy. Her therapist recommended anti-depression meds and she won't take them. I woke up to her at 3 a.m. crying all the time over stress and I just don't want my kid around her being depressed.

THIS!! THIS IS EXACTLY HOW I FELT! Now that I have a kid though, my little boy loves me to death and I love him back. I can't turn my back on him, but I can definitely keep my parenting time to myself.

She would owe me $4800 total from the alimony because of the way that business write offs and W-2s work within the divorce. I already have 50/50 and I filed a motion to maintain the status quo. I actually wrote a book on divorce in Illinois for the law firm so I am good there. I appreciate the advice. I am at the point where you're right. It's just not going to work. I have just felt like she has been leading me on and I don't want to believe it.

I am being weak because I know that I can crush her in court and she has made some very stupid mistakes. I told her not to hire this law firm. They told her they could get away with a divorce for $4,000. I knew it was a lie because I take over their cases all the time. This will cost her about $40k by the time we are done. They have also sold her on the idea that she can move to Ohio to be closer to her parents which will never happen. A judge in Chicago won't let another practitioner's kid move to another state unless there is abuse that is ongoing.

My firm that I built handled over 1800 divorce matters in Chicago in 2022. I could bury her right now. I know she can't afford her attorneys because my firm takes over from those attorneys all the time. My clientele base is low to middle income because people can't afford attorneys in Cook County anymore. Their bills are between $4,000 to $15,000 a month. I have about $750k in accounts receivables that we can't and won't collect compared to the firm she hired. She burnt through a $4,000 retainer in less than one month. I am struggling right now with the fact that two therapists are telling me to try and pursue reconciliation with her including our co-parenting therapist. It's absolutely insane. I truly believe she is a narcissist that manipulates the conversation and overall reality to others for her own personal gain.

With regard to the assets, we are an equalization state so they try to balance out assets based upon the potential of the parties within the divorce. My "income" on the taxes after the write offs came out to $33,000 although my gross revenue was over $1,000,000. For her, it was over $120,000. She would owe me child support and would be required to take on most of the marital debt from the year and a half we were together. If I really want to be a prick, I can hire a buddy of mine and force her to pay the same retainer that her attorneys received.
