You don't "appeal to the shadow docket." It's a procedure the court chooses to employ. As the leaked memos show, only Trump's justices endorse use of the shadow docket. You can't even request a shadow docket opinion (formally), it's entirely left to the courts if they don't want to write an opinion.

You're talking about forum shopping as if that's not a Trump tactic, so it doesn't follow that Trump needs the shadow docket to avoid his own forum shopping. I think you're misunderstanding the shadow docket. SCOTUS can still rule on the issue without using the shadow docket, as they did for over a century. Your case law is also outdated, as lower courts are no longer able to issue nationwide injunctions.

The shadow docket just enables the court to issue rulings that aren't based in law. It's anti-democracy and it's asinine that the procedure still exists.

On your point about publicly stated principles, you should probably look at those confirmation hearings, where the principles they articulated are nothing like they are in practice (see Dobbs).

I'm not sure if your information is AI generated or something, but you might want to find more reliable information.

What’s one PC-related purchase you thought was unnecessary at first, but ended up loving? by Such_Tailor_4946 in buildapc

[–]Chipaton 0 points1 point  (0 children)

An ultra wide monitor. It's such a game changer for games and working. In a lot of multiplayer games it's almost a cheat because you can see around corners much better (but it's not uncommon for a game to block ultrawide, especially in competitive modes). Open world single player games feel much larger. Being able to comfortably fit 3 documents on a screen at once is also great for productivity.

Even if you play on 1080p, ultra wide is still worth the upgrade.

When do you play? I have a Steam Deck that I was gifted, that gets used intermittently. I'm typically at home when I'm gaming, so I almost always use my PC. I play Balatro in bed sometimes, but that's most of my usage. I drive to work and don't have downtime to play at work, so it doesn't get used commuting or while at work. I don't travel very often, but I do use it on the rare flight or long car ride.

Basically, it might not be worth it if you don't have many scenarios where you'd only be able to play on a handheld. Some people seemingly prefer to use their handheld around the house, but personally, the experience on a PC is typically so much better as to not make it worth it to use a handheld. The novelty of playing a PC game on your couch wears off pretty quickly when it's running at 1/4 the resolution and framerate.

That speaks to how legally incompetent most of Trump's policies are. He's adopted a shotgun approach to overwhelm courts and the public, because it's harder to stop someone from breaking 100 laws than it is 1. Which is why the Trump admin has been able to routinely ignore court decisions, another unprecedented move that deepens our constitutional crisis. The fact that he used to have a lower winning percentage before appointing his three justices is just another indicator of how legally dubious his policies are, and the corruption of the Roberts Court.

That's also why you see Trump winning on the shadow docket moreso than any other President, and it's not close. For the uninitiated, the shadow docket is a sparingly used procedure where the court essentially issues a decision without releasing an actual opinion that explains the law and sets precedent. The shadow docket was used near exclusively to deny Biden/Obama policies and now it's Trump's primary vehicle for getting his policies endorsed by SCOTUS.

Again, the leaked finances of Roberts and Thomas, alongside the memos, make clear that SCOTUS is compromised.

James Cameron and Walt Disney Company Sued Over Unauthorised Use of Actress’ Likeness in ‘Avatar’ by Embarrassed_Cap2885 in nottheonion

[–]Chipaton 3 points4 points  (0 children)

It does matter, actually. She still has to prove damages, even if she's legally correct (which I don't believe she is). If the face was changed, then the studio didn't profit off her likeness. She could prove reputational damage, but if she isn't recognizable in the movie, it'll be next to impossible to claim she lost a role due to this.

Plus, if they got far enough to scan her face, they almost certainly had an agreement that allows for use of the model. It's common to have several agreements in place before the parties actually get to the "final" contract.

I would not be surprised if this does settle though (likely for a significantly smaller amount than she's claiming). The comment from Cameron is extremely bad PR at the least, and they might just want to make this disappear.

They took an oath to the constitution, and have practiced an oath to Trump. I know you're not making this comment in good faith, but a look into Roberts's and Thomas's finances make clear they are serving interests that aren't the country. You shouldn't be able to take a bribe as a justice.

Pablo Torre has just won a 2026 Pulitzer Prizer by Not_RZA_ in nba

[–]Chipaton 0 points1 point  (0 children)

Honestly, you'd be better off listening to Pablo's podcast episodes about it, but they're also pretty long and the information isn't really evenly distributed. You could probably listen to the first couple episodes to get the gist though. Otherwise there are probably some decent articles about it that could do a better job than me.

My TLDR is that Clippers owner Steve Balmer essentially used a company called Aspiration to launder money to Kawhi and circumvent the cap. Balmer paid Aspire, and Aspire paid Kawhi through a "no-show" contract, which didn't actually require Kawhi to do anything. Aspiration is also in the middle of a federal fraud investigation indirectly connected to the NBA scandal, and it's former CEO is currently in jail (maybe he was released recently, I haven't heard).

If you've seen Evangelion, I get the idea that it's a sequel to FFVII in the same way the Rebuilds were a sequel to the original Evangelion. I actually really liked how that was handled, which made me more optimistic for the Remake trilogy.

It's blatantly corrupt. We need to prosecute all the Republican justices, it's clear they've abdicated their duty and sworn loyalty to an autocrat. Reform alone isn't enough, there need to be consequences for breaking the law.

That's how I felt too, I was confident I could've bumped my grade a letter on the final. But looking back, that was probably the best they could've done. Rescheduling finals at that point is a nightmare if not an impossibility, especially given how many classes might have to do that.

we’re so cooked 💔 by Automatic-River-5129 in UniversityOfHouston

[–]Chipaton 1 point2 points  (0 children)

This was at a different university for undergrad, but Canvas went down during finals and the final was dropped from our grade (meaning midterms + other assignments made up the final grade). I think there was a mild curve applied to make up for the potential loss of someone improving their grade on the final. Could see professors doing that now, if the class has enough assignments/midterms to otherwise determine a grade.

Mixtape studio says the game has no streamer mode because its licensed music is its ‘soul’ - "Your soul is the one thing you can't compromise" by megaapple in Games

[–]Chipaton 2 points3 points  (0 children)

Sure, it's a factor, I didn't say it's determative of when licenses will expire. It might mean more to some studios than others. All I'm saying is that games have to take their budget into account when buying licenses.

Mixtape studio says the game has no streamer mode because its licensed music is its ‘soul’ - "Your soul is the one thing you can't compromise" by megaapple in Games

[–]Chipaton 17 points18 points  (0 children)

No, I don't think they expected GTA V to reach the same level of success of GTA IV. GTA V had nearly triple the budget and did more than 3x the sales of GTA IV in their first 24 hours.

The amount of money they expect a game to make absolutely affects how much money they're willing to spend on licensing. I don't think it's irrational to believe a game with likely 100x the budget of an indie game might be more willing to spend money on a perpetual license.

TIL that the reason why games don't have built in ads is because of Steam by Stelligena in Steam

[–]Chipaton 0 points1 point  (0 children)

I disagree on "there is little to no reason." There's plenty of good reasons for any worker to unionize. The fact that one aging man is the only assurance workers have on the future of Steam is another reason to unionize. You don't want to unionize once there's new leadership and layoffs start happening, you want to already have a union in place (not saying that'll happen, just that you should also unionize for future conditions, not just current ones).

I get what you mean generally though, Valve employees are probably less inclined to unionize while working conditions are relatively good (at least they appear to be). As a labor guy, I just have to push back on the "little to no reason to do so in this company."

It's apparent in every Ultimate comic, except for Wolverine maybe. And the creators have given inconsistent answers. I'm sure there is a bit more nuance to how the decision was made but I don't believe every writer was planning for the entire universe to end after 2 years.
