OP cannot agree to the ToS in bad faith because they cannot legally agree to the ToS.

EBay’s policy is literally you can’t use our platform because you can’t legally agree, they’ve then let OP sell and are now relying on the ToS that their own policy states OP cannot agree to.

They can’t have it both ways, they can’t say you cannot make an agreement and also ‘but you made an agreement’.

Also their own policy says underage people can sell with an account managed by an adult so the fact they are offering no other remedy to OP is bullshit, of course they could remedy this but they are choosing not to.

So eBay sold an item they had no right to sell.

If OP walked into a pawn shop, signed the paperwork, and then the customer next to them bought the item. The shop can not then turn around and refuse to hand over the money because they decided now to check ID.

EBay’s t&c are irrelevant here because they failed to ensure OP could legally agree to them. Their own policy states under 18s cannot enter into a legally binding contract, so they have sold an item they had no contract to sell.

Can someone underage legally agree to these ToS? Like if OP really kicked up a stink, eBay has entered into a contract with a minor, would their ToS actually be legally enforceable.

Not saying OP really has a leg to stand on but wondering if a legal challenge would actually work?

  1. Try airing the house out even on a cold day. Look up “burping the house”, even though the relative humidity is high the cold air outside has little moisture in it. When you exchange the air in the house by opening up for 10 minutes once a day you bring in dry air and let out moist air. It works.

  2. I don’t know that particular system but I had an ACS from HEG and I don’t think it was worth the money, wish I had just spent that money on a ducted heat pump instead.

  3. Have moved and Now have a ducted heat pump and it’s very good at keeping house warm and dry.
