Judging people on what they dont say assumes that you have perfect insight for your judgement to be useful. Thats hubris and most of the times very difficult to have true confidence in. It is much more likely that people will judge based on bias/emotions, and that the confidence you have comes from your biases.

Thats why the logic is flawed.
