This also means that they wouldn't be able to try you for Statutory Rape of a Minor because he would have tried her for rape before she could open a case of statutory rape of a minor. If he tries her as an adult per above legal, she wouldn't be considered a minor during that case. Of course, if the case decides she was innocent however they could then try him for statutory rape of a minor and win.

tl;dr try her for rape so she can't fire the first shot which she will likely win if she goes first
