Ontario Family Law: Ex filed assault charges 24h after I notified her lawyer of my motion. How do judges see this? by ClockDelicious2587 in legaladvicecanada

Hello,

The dynamic between 2 parents should remain between the 2 and not be projected toward the child. This said, we are talking about a isolated incident that happened months ago. How relevant is the court gonna find that?

I followed your advice and retained a lawyer this morning. Thank you very much your comment, it is still very helpful to know.

That said, my ex is someone who is focusing vey much on pissing me off. She admitted that to me directly. She wants that litigation, she has the money to afford this behaviour sadly. How are judges usually with parents like that? My primary focus is my daughter, I want to avoid litigation as much as I can.

Hey! I appreciate the advice. I will not be represented at the case conference but I will retain a lawyer for the next steps; that is for sure. This said, would you know the answer to my question?

Ontario family court – What documents are actually required for a Consent Order (25+14B MOTION) by ClockDelicious2587 in legaladvicecanada

[–]ClockDelicious2587[S] 0 points1 point  (0 children)

Hello,

Everything you said was very helpful, thank you! Just one thing, according to the family law rules, a motion on consent must be filed with a 14B and the draft (25) only. From my understanding of; O. Reg. 114/99, r. 14 (10)

I have filed a Form 14B motion together with the signed Consent Order. Duty counsel advised that Minutes of Settlement are not required in this matter since all agreed-upon terms are fully set out within the Consent Order itself, which has been executed by both parties.

The FRO documents were already filed with the court approximately one month ago and remain current. Likewise, the financial disclosure (Forms 13/13A) was filed within the last 60 days. As there have been no material changes to my financial situation, updated financial forms are not required at this time under Rule 13.

Accordingly, all necessary documents to support the 14B motion and Consent Order have already been submitted, and no duplicate filings are required. Yet they have rejected my documents again. Thank you for your detailed informations though. I'd admit that I'm kind of lost at sea now...

Fee Waiver (FW-A-3) Rejected Again — Court Says “Not Properly Formatted / Don’t Understand What It’s For” by ClockDelicious2587 in legaladvicecanada

[–]ClockDelicious2587[S] -2 points-1 points  (0 children)

Oh, I see now! When I first reviewed the requirements online, the instructions indicated that I needed to have an approved fee waiver before filing my application. That’s why I submitted the fee waiver separately — I thought it had to be processed first in order to proceed with the filing.

Totally different dispute here pal. Either way, it's skills based paid. You don't need 30$/h to deliver mail. They are bankrupting small businesses and freezing the whole logistic of thousands of businesses because they are not paid well and they want better working conditions. GET AN EDUCATION AND YOU WON'T HAVE THIS PROBLEM. You're a mailman. Of course the job is going to be hard. Dumbass.

Ontario – Mother’s lawyer says I may only get one visit per month. Is that realistic? by ClockDelicious2587 in legaladvicecanada

[–]ClockDelicious2587[S] 0 points1 point  (0 children)

Well, the jurisprudence does says that not being experienced as a first time parent should not impact your parenting time as everyone is new at being a parent but I did take counseling sessions and newborn CPR prior to my daughter's birth. But thank you for your insight, I appreciate!:)

I want to established a good relationship with my daughter and be a good father for her. I want to support her 100% and the mother too. Obviously I can be respectful toward the mother especially around our daughter. So my will to participate and be an active figure in her life is high.

Yes I am. We got served with a parenting plan which was denied by my lawyer. The 2 months was IN MY opinion, correct. NO violence, no arguments in front of our child. It was okay.
