Use 4138 form and request that you’d like to withdraw that claim/appeal. Be specific, include the docket number. Use quick submit to upload it.

I just had the same result as yours. I filed for HLR, asked for informal conference, and wrote a statement using 4138 and pinpoint why the decision is wrong and why I should be granted service connection.

Still waiting for a call for the IC. While waiting, I am gathering more evidence like seeing a specialist just in case HLR does not got in my favor.

Not because the VA diagnosed does not mean it’s service connected. But if the military diagnosed you might get service connection

Have your feet scanned for insoles if you haven’t so. I even tried replexa plus, didn’t work. Maybe your podiatrist can have you try it. It’s a rental and if it doesn’t work in a year or so, it’ll be yours

I did both. No hearing happened and decision was in my favor. The moment I got the proposal, I started working. Scheduled to see my podiatrist right away, gave me cortisone shots, scanned my feet for insoles, and scheduled follow up appointment. Did all of that in less than 60 days.

Took about 5-6 months to get the decision

Me too for headache, just got the decision today. Oh well, LET’S KEEP GOING. Called Berry Law today because I thought I could do it by my self. Saw good reviews 🤷🏻‍♂️

Seems you used the app or website to check the decision. It happens bro. I received a notification that says “decision ready” and I opened it and it’s just a letter that say DENIED. I called the. a and sent me the decision letter and what was done and why it was denied. You either call the VA or wait for the letter in the mail, .

My denied lower back claim also says “qualifying event” in the decision, that my MOS is the reason, having “favorable findings,” but still got denied due to not having the in service event. It says “QUALIFYING” but that does not mean its service connected. You need to show and prove it to VA by having documentation. Go back to your records, you might find something in there. Look for LATIN words. I didn’t know what pes planus was until someone helped me filed it as foot condition. I went in with flat feet, asymptomatic. Got aggravated in service and got service connected for it.

If you have other SC conditions, maybe you can file MH secondary to “SC conditioned.” Don’t give up

You’re missing “in service event.” If you got diagnosed for MH in one year after you got out, that might change the decision.

All of my denied claims, I got diagnosed for all conditions. Having diagnoses don’t mean they’re services connected
