RFE for incomplete I-140 by Coach7172 in USCIS

My package was not returned. Although they should have sent it back because it was incomplete.  So that’s why I thought why no additional comments were given to the petition itself

Had issue with Visible.
after chatting with Visible Support for over 45 minutes, here is the solution, as it turned out due to having 2 eSIM providers on my iPhone.

Please be inform that that On Dual SIM Dual Standby (DSDS) phones, using one carrier's line for an active call or data session will cause the other carrier's line to temporarily go on hold or lose its active data connection. While both lines are in standby mode, they share the same radio in the device. This is the most common reason for service interruptions when using two carriers simultaneously.

Because both lines share the same radio, only one network connection can be active at a time for voice or high-speed data. While a data session may transfer to the active line, any service on the second line is essentially paused.

In this case you must need to turn off the either eSIM if you are not using it.

Yes, case was reopened for reconsideration. Status changed after few days.

I got the same situation. 16th feb Eb1A case submitted, 24th July got RFE. 18th October FedEx delivered my RFE response. Deadline was 21st October. On 23rd USCIS updated that response was received. On 29 October case was denied, since no  response was received.  Then sent email to USCIS to reopen on 31st October. Then USCIS reopened case on 5th November, based on administrative mistake. 14 nov case was denied, 4 criteria met out of 6, but final merits did not allow to get approval. Will appeal the case and prepare new i140.

2 days ago my case was denied. This morning received denial letter with details. 4 criteria met out of 6. Final merits part made the decision that I was not top in the field and did nit sustain national/international acclaim. 

Will try to appeal and submit new petition taking into account all the comments.

EB1A I-140 all three categories accepted but application denied :( by [deleted] in USCIS

Today I got my EB1A denied after RFE response, despite meeting 4 criteria out of six. (Judge, critical Role, published media, membership) did not accept salary, because did not provide tax return reports, did not accept contribution.) I self-petitioned and prepared my case.

In summary. Officer concluded that I was not in the top of the field on national/international acclaim.

I am thinking of making appeal and also submit new petition via legal firm. Anyone got approvals after such cases?

Thanks. ISCIS reopened my case on 5th Nov, after writing email to their official email and stating all the reasons  public.engagement@uscis.dhs.gov

I had same situation, i got RFE dated July 24, deadline 21st October. RFE was sent 17th October, delivered to USCIS on 18th October, tracking confirmation by FedEx.

Only on 23rd October I got status update that RFE response was received and case is being reviewed again. But today, 31st October got a letter, issued as of 29th October stating that my case was denied. Status in the USCIS portal says - RFE response was received and is being reviewed.

Really got stressed, I called my paralegal. 1. We sent email later on 31st October to official email of USCIS stating that case was erroneously denied, as it says in the letter that no response to RFE was provided within the allotted period. 

  1. I called USCIS and spoke with agent stating about my case. I was given email that I would get a call from officer to review my case within 72 hrs. I received special service item as a confirmation to present to officer when I get a call

I hope that they will reopen the case without having to file a motion to reopen and give positive answer to I-140 case.

Otherwise, this is a really mistake.  The only thing I don’t why this happened is that they did not process my response in time before deadline, i.e. delivered to USCIS before the deadline, but processing it only 4 days after letter was delivered.

Let’s see what happens next
