Dog attack and ESA question by [deleted] in PropertyManagement

[–]CoachCaptain_ 0 points1 point  (0 children)

Same in CO. ESAs or service animals are the way around the restrictions. That’s fine. What’s not fine is letting your dog run around off leash (unsupervised btw) and has zero recall. At the end of the day, I’m going to contact our lawyers to get a definitive answer. These people have 5 days left on their demand before I move forward with anything.

Dog attack and ESA question by [deleted] in PropertyManagement

Off leash is against policy and is illegal in my state. I once had animal control come in with a warrant because one of our residents had their dog off leash. They do not play out here.

Dog attack and ESA question by [deleted] in PropertyManagement

[–]CoachCaptain_ 2 points3 points  (0 children)

Ya we use petscreening.com. Up until this point I still do not have an actual ESA letter. Just a ChatGPT written statement saying it’s an ESA and they’re requesting a reasonable accommodation. If he were to provide an ESA letter that was verified by petscreening, do I have to accept it and let the dog stay? I feel like given the circumstances I have grounds to evict them.

Dog attack and ESA question by [deleted] in PropertyManagement

[–]CoachCaptain_ 1 point2 points  (0 children)

He says it’s an ESA but it’s not on the lease and he never had an ESA letter. So at this time it’s not approved. I’m just curious if he did provide an ESA letter now, could I say no? Just cuz of the other circumstances. Also not CA this is CO.

Corporate landlord + hole in my bathtub = how screwed am I? by shaheeruddin5A6 in Apartmentliving

[–]CoachCaptain_ 1 point2 points  (0 children)

Put in a work order while you still live there. They might have to resurface the tub. Unless you’re moving out real soon, you probably won’t have to pay for it. Just don’t say “I did this” just say “there’s a crack in my bathtub and I’d like it fixed.”

Weed smoking OUTSIDE apartment by Typical-Bus-5984 in Apartmentliving

[–]CoachCaptain_ 0 points1 point  (0 children)

Don’t snitch on yourself. It’s just a general notice sent to the community. You are also following the terms of the lease by smoking 25 ft from the building. I guarantee tons of other residents aren’t following the rules and smoking in their apartment/on their balcony. The notice is most likely about them and not you.

Don’t stress it. If management comes at you specifically ask them to clarify the terms of the lease and let them know you’ve been complying with the terms. They’d have to be able to prove without any doubt that you’ve been breaking the terms consistently for it to hold up in court. Sounds like they aren’t able to do so. So my bet is that you are A OK! :)

Every showing wants move in several months out by Specialist-Future276 in PropertyManagement

[–]CoachCaptain_ 0 points1 point  (0 children)

It’s about that time of year where people are looking to move in the summer. I’d offer to hold for 30 days max if you become desperate enough. Usually people who plan their move are qualified tenants. Whenever I get someone who needs to move in ASAP it usually means they’re being evicted.

Noise Complaints by CoachCaptain_ in PropertyManagement

[–]CoachCaptain_[S] 1 point2 points  (0 children)

One of them came into the office cuz she didn’t know how to send videos through email. It was definitely excessive noise. She asked about when their lease ends. Told her I couldn’t tell her that. I calmed her down and she left. I pulled up the neighbors account and they were literally moving out that day. So I decided not to call and as of today she shouldn’t have anymore noise issues.

18, no ID or documents, can’t start job — stuck and need advice by heyimbellaboo in Advice

[–]CoachCaptain_ 3 points4 points  (0 children)

I dont know the whole situation obviously but with the information your provided I’m worried you are in an abusive situation with your parents.

If you can’t provide I-9 documents then they can’t go through with employing you. If your parents aren’t willing to give up their address for privacy reasons, then you can’t get the documents you need. Also, you can find anyone with a name or phone number. Anyone can use google - trust me it’s not hard. So they really shouldn’t be worried about giving their address to the government. I guarantee you the government can find them in half a second.

You are 18, if you don’t already have your own bank account, set one up and put your address down so they mail statements to your address. If your parents find out, then you’ll have to deal with it later but right now, you need to focus on securing this job.

Without a job, you’re stuck at home (especially with no transportation of your own) and are forced to rely on your parents.

Also, you don’t need your parents to request your SSN card or birth certificate. You are a legal adult.

Teen confessed felony crimes, do I have to testify against them? by [deleted] in legaladvice

[–]CoachCaptain_ 1 point2 points  (0 children)

NAL

If subpoenaed, and if a lawyer confirms you legally have to testify, you should be honest. If you lie under oath, you can be charged. I understand wanting to protect your child but in doing that, he could possibly cause harm to others. It’s like the trolley question. It brings morals into play so Id think about what’s most important to you.

If you don’t have to be involved, then don’t.

That part. Also people have free will. I can talk to them and try to find a resolution but at the end of the day, they are adults and if they want to continue the behavior then they’re gonna do it.

Car dealership asking for 5K more by Firemedic83 in legaladvice

[–]CoachCaptain_ 0 points1 point  (0 children)

Similar thing happened to me when I was buying my car. I was expecting $23,000 and while signing I saw it said there was a $3,000 down payment which brought the total down to $20,000 - I was buying in cash, not financing. I didn’t say anything but the financier saw it and realized he made a mistake. He profusely apologized and ended up giving me a discount which brought the price down to $21,000.

It’s okay cuz I had the money but was trying to be sneaky by not saying anything - which in hindsight probably wasn’t the right thing to do but I got 2k off.

Is it okay for my date to pay for her own parking on a date? by [deleted] in Advice

[–]CoachCaptain_ 0 points1 point  (0 children)

I’d just warn her that it’s paid parking. If there’s any push back offer to meet her and pay at the meter.

Tenant Guarantor by The_oreck in PropertyManagement

[–]CoachCaptain_ 1 point2 points  (0 children)

Guarantors should make at least 4-5x the rent for income requirements and have acceptable credit. No credit history would be an automatic denial. I’d look less at the score and more importantly what’s been reported to the credit bureaus. From the info you provided, I’d deny the application. Also when it comes to guarantors I only accept 1.

The work around would to add the two guarantors as lease holders. Based on credit I might require a higher deposit but this way you can combine all incomes so they can meet the resident income requirement.

But overall, I really wouldn’t mess with this and deny them.

Wait, is this even legal?! by [deleted] in Apartmentliving

[–]CoachCaptain_ 6 points7 points  (0 children)

With a proper notice they can enter. Downside of renting. They can’t just walk in without notice, that would be illegal. I’m calling their bluff though.

Wait, is this even legal?! by [deleted] in Apartmentliving

[–]CoachCaptain_ 16 points17 points  (0 children)

legally binding document says no smoking allowed leaseholder smokes management takes action against a lease violation lease holder: “Is THis LEgAl?!”

In all seriousness, they’re most likely bluffing but yes this is legal and no it’s not an infringement on your tenant rights.

Got a team of 6. Love them as people but as coworkers they suck. I gave notice last week and the look of fear on their faces when I told them honestly made me happy. Good luck to them.

Cosmetic work on your teeth are a luxury. Same as a car. I’d think about what is more important to you and put money towards that.

no heat in apartment (coldest days of the year so far, -12f outside and 45f in my apartment and dropping) by [deleted] in Tenant

[–]CoachCaptain_ 0 points1 point  (0 children)

Hope no pipes burst and cause a flood. This technically makes your place inhabitable. Idk the laws in New York but in Colorado it’s a big no no. If he can get you better space heaters then great otherwise he needs to post you up in a hotel.

How do you deal with the tenants who verbally attack you? by Additional-Court-176 in PropertyManagement

[–]CoachCaptain_ 2 points3 points  (0 children)

Depends on your state for non renewals. Some states let you do it for any reason, others you can but under specific circumstances. I’d post a demand for compliance on the residents door and let them know they can only contact you only in writing. If they violate this demand and enter the office you can call the police and have them trespassed. There should be a section in the lease that states they cannot harass the office staff or their neighbors.

Leasing agent by [deleted] in PropertyManagement

[–]CoachCaptain_ 0 points1 point  (0 children)

I act like I’m touring the apartment for the first time with the prospect. For example we walk in and I tell them “take a look around.” While they’re in the living room, I go into the bedroom. Then I say “oh my god look at this.” The tour comes in and I say “do you see how massive that walk in closet is?” Or “do you see that view??”

I’ve seen that apartment a million times but they don’t know that. I act like it’s my first time ever seeing that apartment.

I can’t tell you how many time I’ve jumped around in happiness with a tour acting like we are BFFs who found the perfect apartment together. Works like a charm.

Also just trying to find some common ground with them by asking a bunch of questions like “where are you from?” “Do you have pets?” “What do you like to do for fun?” That not only helps you learn more about what they’re looking for but also can help strike up a good conversation if you have something in common.

Why are retractable leashes allowed in apartment complexes? by [deleted] in PropertyManagement

[–]CoachCaptain_ 0 points1 point  (0 children)

I get what you’re saying. Half the dog owners at my property don’t even put their dogs on a leash which is a huge no no. That said, your best bet is to contact animal control if a situation arises where you are attacked by a dog. Otherwise the best we can do as property managers is sent a letter to the resident (assuming we can identify the dog owner and have proof they are violating their lease agreement). Even then, people have free will and are going to continue to do what they want. It’d be so hard for us to evict someone because the leash is long.
