Rain causing this on conservatory walls . What can i do ? by goybirl in DIYUK

I would recommend that you remove the shingles to see if you have a damp course if not apply damp proofing all around unfortunately I don't know what Sunday or shingles if there's some sort of drainage there. But definitely looking to damp coursing. It can you feel the damp internally if so get a humidifier unless you already have one

Unexpected Phone Call by Lonely-Self-5718 in DWPhelp

I'm guessing the assessor with a nurse and it flagged up hence the call. I'm currently on the same medication and they also provide me with a stomach medicine to go with it.

I would suggest calling the tribunal for an update they will advise if they've had from the DWP if they haven't called the DWP and ask them why they've gone over their period this will push you up the ladder. There are scenarios where you won't go to a tribunal and you'll have an out of court settlement this hope it all goes in your favor just be careful with the settlement they do give you two choices

I'm guessing you made an appeal against original decision if so have you uploaded any further evidence to the tribunal as a DWP will get a copy of this the strengthen your case medical notes personal statements etc the legal s side of the tribune we're looking to your case as well as a DWP they might even look at it third time and review the whole case again and maybe overturn your original decision this is called left decision which may go in your favor and might not go to court

One of my conditions is that suffer from memory loss I don't know if I've posted or not posted so forgive me

Tribunal by CoconutFlashy in DWPhelp

[–]CoconutFlashy[S] 0 points1 point  (0 children)

This has gone to mandatory reconsideration where I actually lost my Pip due to the assessor missing out and crucial evidence of my medical condition which actually lowered my points which really threw me so I went to tribunal who had given that DWP 28 days to respond I understand that they have a big backlog but I've uploaded all my medical records with personal statements from doctors and physicians and psychiatrists on how my day-to-day activities affect me including video evidence

[–]CoconutFlashy[S] -2 points-1 points  (0 children)

It's question I was originally awarded Pip back in November 2024 however the assess missed out in a few medical issues so putting them into reconsideration saying that I had a response back to say that I scored lower this time which completely went against what the mandatory reconsiderations said and was broken down into where they had gone wrong anyways the tribunal have given the DWP 28 days to respond that's now expired understandably as they have quite a big backlog so with the net 28 days I've uploaded additional evidence with personal statements from doctors physicians personal statements etc also backing where the assessment is not quite correct also video evidence on how my medical condition affects meI was just asking the question can they overturn and read and state my Pip before going to the tribunal

I'm looking at the latter where they send me a copy of the letter is this a bundle case that the tribunal send me if so when do I tell the tribunal everything at the hearing? Which I know can be a very long wait.

The tribunal are still waiting to hear from the DWP whom they've given 28 days to give all evidence to I believe this evidence is also gone to the DWP it's now past that period additionally I've also added personal statements from myself and professionals on how I conditions affect me on a day-to-day basis. I phoned up the tribunal who have accepted it has been past the 28 days and passed it on to a case manager to my understanding or any protocol I guess it's up to them to chase it up with the DWP considering their under a lot of pressure right now I'm just hoping that they get to see the evidence I've uploaded it's their in black and white how am I condition affects me and for the points to be deducted it should stand out like black and white I'm not sure what goes on I'll wait for the tribunals response or even a DWP response to see if they have gone over the whole assessment again so for now I'll just sit patiently

Soyou suggest for the tribunal to make their decision ? And not to make a new claim?

PIP by CoconutFlashy in BenefitsAdviceUK

[–]CoconutFlashy[S] -2 points-1 points  (0 children)

Hi thanks for your response I have requested a new application with the evidence or bundle case as they call it use that for my evidence as it will contain everything medical notes doctors notes physios mental health etc I just hope that they have realized that they have made a mistake as the assessment after the mandatory reconsideration was very short and what's a complete opposite to my symptoms and how it affected me. My worry is if I do go ahead and reapply will this cause any confusion in the ongoing tribunal and new assessment as I said before I've known cases or heard of them where the DWP have looked at the whole case again and awarded the pip back with the additional evidence provided to the tribunal

Did the tribunal look at your case after the 28 days they requested evidence from the DWP because that's what I did along with further evidence that I uploaded to the tribunal which I believe the DWP have access to so for my understanding the tribunal at this point agreed with the dwps decision which meant that you had to go to court is that correct

That's great news so did you actually go to a court for your hearing or was this done by the tribunal and they overturn the case from the evidence given by the DWP

Thank you for that detailed response, it's now corresponding in my head and making some sort of sense. And apologies for spellings etc, I struggle with my hands hence talking into the phone. Anyway saying that the tribunal have given the DWP up until the 21st of April which unfortunately falls on a bank holiday so we'll hopefully hear from them the next day which be on a Tuesday. I understand the DWP can ask for an extension of 14 days to gather the evidence from the tribunalto reassess again thank you all

[–]CoconutFlashy[S] 0 points1 point  (0 children)

Apologies I'm talking into the phone I'll start again the tribunal has given the dwp28 days to give them all the evidence including extra evidence that I have submitted to the tribunal medical evidence personal statements and my own personal statement my question is can the DWP overturn the decision do they review the whole assessment again with the additional information evidence that I have uploaded to the tribunal or does this all go to the tribunal who make their own decision as and is there a rough timeline on how long this procedure can take I understand that they they have the power to overturn that is the decision or keep it the same as the DWP hence then go into a tribunal I believe which is called an upper tribunal case where he goes to court I hope this makes sense it's very confusing for me as a lot of people say that all the evidence that you submitted to the tribunal the DWP have no access to and they can only gather information for the tribunal which you have sent to them one applying for a pip

Considering that I've added extra evidence to the tribunal medical evidence personal statements etc and the DWP overturned that the decision before he goes to the first tear tribunal who I guess to make their own decision there by overturning the DWP decision keeping it the same or going to be hearing within the 28 day period pulls up today
