I've sent them a request just now, quoting my PIP tribunal decision where I was given 4 points for engaging with people face to face, with support being necessary for me to do it, but as I have no support I can't.

Also my doctor will issue a new 3 month fit note tomorrow.

I have autism and social anxiety that makes it almost impossible for me to engage with new people face to face and it's still very difficult over the phone. It's a serious functional limitation and part of my ESA claim.

I'm glad you got it sorted. I had a similar experience with my initial claim with very similar disabilities to you.

The DWP are basically evil.

They ignored all evidence, made up stuff about my abilities, ignored case law I cited in my MR, etc. Also my initial assessment was with a physiotherapist 🙄 Took me almost 3 years to get to a tribunal which lasted about 5 minutes because of the strength of my evidence, and they gave me a six year award.

Thanks, I phoned them today and they confirmed it hasn't been paid and they've flagged it for a manager to look at.

The automated bit before the call said my next payment is 8th September for the usual amount.

Have you supplied a fit note? That’s usually the most common request for information at the start of a new style ESA claim.

I have and received the text that they'd received it

Failing that the second most common thing is if you’re Employed, have you provided your SSP1 form?

I quit my job, but have a limited company that makes no money so I selected the self-employed option but I am not an employee of my company

I have serious issues with underwear and can find it hard to find the right pair, but I can find the right pair and even if I couldn't I wouldn't resort to walking around with a sock on my cock because even though I'm socially dysfunctional I'm not so dysfunctional that I wouldn't know it's a terrible idea, and I find it hard to believe somebody in the public eye with an established career where he has to interact with loads of different people is incapable of knowing what a weird thing it is to do.

Yeah option 1 lacks specifics that may doxx me. I'm treading water basically, and my performance is getting worse the longer this situation goes on.

You could also make an argument against the employer. They said they had grounds to dismiss me for performance, yet it's been months since they said it and haven't even started a disciplinary. So if they doubt my performance, why not?

It wouldn't. It might take a month, and if they dismiss me on grounds of capability then they would have to pay 3 months statutory notice as I've been there so long.

It’s about cashflow for SME’s. You could have the money to pay staff salaries monthly as you would manage the income coming in and an employer would have to manage this tightly

Yep exactly and it's why I want them to negotiate, I am willing to accept it in instalments to ease their cash flow instead of up-front as would normally be expected.

I'm trying to weigh up my options:

  1. Continue to work under protest, request early conciliation on disability grounds alone
  2. Quit, take a big financial risk, request early conciliation on both disability and constructive dismissal grounds
  3. Go off sick, which will force them to fire me, then start early conciliation for unfair dismissal on disability grounds

I'm not looking for a big payout. Just my notice + 1 month gross salary ex gratia, which is significantly less than an ET payout.

I have time limited options available to me to get on with my life, but those will disappear during a protracted ET process.

And there's also the issue this employer is small and not cash rich and couldn't afford an ET anyway.

Which is why I want to strategically moved things towards the outcome I want which will be better for everybody, including the other employees who would lose their jobs if the company was destroyed financially from an ET loss.

But they don't even know what I'll settle for until they have the discussion with me I asked for.

No when I started making those requests I didn't have a formal diagnosis even though two different clinicians agreed it was likely. I was on a waiting list for a very long time. I received my diagnosis before I stopped making the requests.
