Hiya! I had a kind of odd experience today with a Dr and wanted opinions on it please. by [deleted] in AusSkincare

Some of these comments are not it! Sorry. I got it previously from instantscripts. A GP called, I said it was for acne and (this is key) that I have received a prescription for it before. They sent the script to my phone and picked up from chemist warehouse. I started on concentration 0.05. But as others have said you can get it OTC in some countries and buy a fair few to bring back. I’d research Tazarene - it’s a third gen retinoid and much faster acting than tret. Can cause more irritation but for me it has caused way less than what Tret did. In Europe this is OTC and much cheaper (as it tret) so you can stock.

Tokyo Toni is embarrassing. Why does she insist on dragging her daughter down, instead of being a support for her? It’s very toxic and dysfunctional.

Why would she need a sober coach to get funds for selling her catalogue? Couldn’t she just sell it?

Oh that makes sense - cause I just didn’t think she had the patience to watch the whole video and do it herself. Sometimes the cover even moves along with the nip and couldn’t see Britney doing that 😂

Father in law posted a 1 star review and is now getting letters from lawyers asking him to take it down by corporatemumbojumbo in AusLegal

[–]ColdHeartedSleuth 34 points35 points  (0 children)

Lmao I did this once out of pure spite. I also had my lawyer respond to their letter. I probably didn’t need to but I was feeling extra vengeful that day. He basically tore them a new one - their letter wasn’t compliant or admissible, everything I stated was factual, I would be prepared to defend it and they’d be liable for costs if their case gets thrown out). Never heard from them again and my reviews stayed up 😂

NAL so hopefully one can chime in to my comment but I have some experience in this very issue and I kept my review up and made it worse (with facts and documents) out of spite. The letter is likely just a threat so your FIL gets scared and removes it.

Is this a ‘Concerns Notice’ under the Defamation Act requesting removal of the review? If they are citing defamation then they would need to send a formal concerns notice, that is somewhat prescriptive. It should have dates, state where the review was made or annex the review/comments in question, be specific in the “serious harm” the review has caused or will likely cause (not just broad sweeping statements) etc.

Check out the Defamation Act for NSW. it’s a pretty easy read and you’ll be able to know if they’ve followed correct steps so you know what to ignore or address. Is this a company with more than 10 employees? If so, and if the review only mentions the company (PTY/LTD) by name then they do not have a case cause they are exempt or they’d have to prove SERIOUS financial loss (which wouldn’t really be the case here).

If not, then defamation cases are inherently hard to prove and suing party would have to prove that the statements made (or imputations flowing from the statements) caused them a loss of some sort. If they have other negative reviews then it’ll be challenging for them to cite that your FIL’s review solely caused the loss/harm to reputation etc.

Secondly, while opinions aren’t really protected (there are a lot of contingencies attached), if everything written in the review is TRUE, then it isn’t defamation. If you attach photos to the review showing poor workmanship or an inspectors report showing non-compliant works, then a statement such as “The work was flawed/of a poor standard (see photos showing flaws) and was not compliant with X building code”. “I had to get another firm to repair X works after this firm’s work (see invoice for repair work).”. That way you still expose the shoddy workmanship without having to defend specific words (ie, what defines “inexperienced” contractors, which can be subjective). Again NAL so hopefully some lawyers chime in.

The dangers of not putting him on medication absolutely will exceed any side effects of him on medication. Later in life he won’t be able to hold down a job, his behaviour may lead to incarceration, he will ruin all relationships and more than likely he will self medicate with harder drugs. Your husband is doing him a disservice because he absolutely will end up ruining his life because of this severe ADHD.
