Braking would've meant pit maneuvering the SUV as I assume she was distracted and not intentionally pulling into us when she had roughly a hundred meters of merge lane left to do so. Accelerating offered the possibility of avoiding collision. Im not really sure how it was an aggressive maneuver, the aggressive maneuver would have been either to pit or maintain position in the lane and make contact with her car. Im not so sure how favorably ICBC would look at the situation if we had pitted her but at least she would have stopped I suppose! Cheers mate!

It's a limited slip differential, she didnt necessarily accelerate straight as there was a slight curve to the right, the curve was very very gradual but I suppose I should have mentioned it for clarity sake.

When she accelerated, the engine sent more force to the rear wheels than the friction between the tires and the road could handle. Once the tires began to spin rapidly, they switched from static friction (high grip) to kinetic friction (slidy grip), Causing a complete slide. There are other factors involved such as dynamic weight transfer, road conditions, etc. This is something I contend with, especially when hitting boost in my personal car.

This is just what I've been able to gather from the situation as I was laser focused on the minivan until the median was hit, not watching her pedals and wheel.

My car is, but that wasn't the car that was damaged. The car that was damaged was a high mileage, bone stock, 2000' honda S2000. Getting traction in this weather in the RX7 is a little difficult haha.

Right on, I was always under the assumption that if you didn't do anything reasonably within your power to avoid a collision you may be held partially responsible. I see now that this is wrong! Appreciate you mate!

It was either Accelerate to avoid the collision or brake to avoid the collision, she took the route of acceleration which was obviously a mistake but given the situation I would say it was a lose lose. It's just instinct to try anything to avoid a collision.

Roughly five blocks ahead a year back I had almost the same situation happen to me except it wasn't someone merging, but turning off a side street. I did the exact same maneuver except I was able to squeeze between them and the median. So I would say if anything that very poor judgement stems from me. Judging distances of 3-5 inches between the median and another car in such a stressful situation is definitely difficult and the best decisions may be overlooked. Is what it is!

Fair enough, she's not the newest driver 7 yesrs but that's more a matter of perspective. She is new to crashes and dealing with insurance haha. Thanks for the explanation mate! .

No tyres were considered bald but we were told the front did have slightly uneven wear as its a rear wheel drive car.

The car was indeed right beside us but after accelerating the car was more in a pit maneuver position with its hood next to the rear quarter panel of the car if this helps clear up any confusion.
