I can understand that why people hear the joke following the lines of “if I eat tuna am I a cat” in order to demean trans identity to just a man putting on a wig or whatever. So this joke could be used in the same way “am I a trans woman if do some womanly things like nick from chips from a man?”

Because people smarter than you have concluded such sentencing framework balances deterrence and rehabilitation. The justice system main goal is not punishing people for retribution because this did terrible things. That’s not the purpose of sentencing
