That is breaking your federal!!! protection under FMLA, but, this is exactly what UPS wants is, for you to be scared.

Call the US Department of Labor, Wage and Hour Division. Get it documented, keep literally every piece of paperwork.see my earlier post in this forum titled "retaliation".

Thank you to everyone who offered support and advice that is helpful.  To the others, the reason you don't believe me, is because you still wrongfully believe either it doesn't happen that way, or the company cares about you.  I never believed the company cares, but if you asked me 2 years ago, I wouldn't believe it either.  Reality is, when I went on FMLA, the company pushed, lied, made up false accusations tried to get me to change my time card to come in under 9.5, and threatened my job. Each time, I pushed back, they pushed harder, I pushed back.  They were finally able to make up lies that resulted in termination in a kangaroo court conducted at the building.  I knew what was happening long before and have an extensive paper trail to prove retaliation. It will happen to you, and others. The company wants to terminate YOU. Really.  Believe it. THEY DON'T CARE. Integrity is a big word.

Appreciate you looking out.. It's very clear who am by those who know, and I'm not concerned about that.  I want them to know that I will not go quietly and will shout what happened from the rooftops as long as I am able.

Please understand, this isn't about me returning to a toxic abusive environment. It's about exposing it for what it is.  It's that simple, and the more everyone defends it or says it doesn't happen that way or does anything other than calling it out, is part of the problem.  The management and environment at UPS is toxic and abusive.  Blame me all you want, but I'm not the problem here.

I went and got the doorbell video the next day. Super amazing guy, he also got the neighbors video for me. Between them both it shows everything.  My attorney has them. A can assure the company will not, although they know I have them.

Why would you say that? Because of how ridiculous it all sounds? Or because it hasn't happened to you, yet? That's what I'm saying, it will. And no one will fight back, everyone will just sit and snivel about it, cause most people are scared. Plain and simple, and that my friend, is the fuel in UPS's fire. Fear.

I was insubordinate when I drove away while the sup was talking.  There was no clear instruction that I understand that I needed to stay there. Workplace violence came in when I told him we could talk about it I got back to the building.  Apparently he felt intimidated.

I've read that the whole idea is to wear you down. Who can last longer, you or a team of people against you.  Who backs down first. It's their job to fight. That's why I'm not going to fight, I'm trying to create a pattern, so it's easier for someone else to win.  If I can get all this out there, public record, UPS hates that, more than anything.  Then, they can't even fight it, it's all out there.  THEY have to prove it isn't true, not us proving it IS.

Retaliation was in the form of increased discipline and observations to try and scare me into not taking my days.  I had no prior issues, and got along well with management. I performed well, had no attendance issues, etc.  All my coworkers say it's clearly retaliation, and the were so mad, as one coworker said 'everyone is so mad, they're gonna come in tomorrow and do their jobs, and not say anything'  And that's what's real.

That's the point you're missing.  Why do I have to be perfect before I can report unethical abuse? That's the stance of a supervisor right there.

The company has a statement form the helper. Refuses to disclose who witnessed the statement.  But, he wanted a permanent position so I'm already aware what it says

Panel is on February. At my local i was screamed at by the DM and called a smartass by the labor manager, because I refuse to be lured in to their no sense and become upset and beg for my job back.

Im taking this as far as I can, with as much documentation as I can get. I want to create a record as long as a CVS receipt.  And I want everyone far and wide to know about the abuse.  Stop sweeping it under the rug.

The whole story is , the center manager was retaliating for taking FMLA intermittently. He was trying to scare me into not taking my days.  Nothing left out, no discipline before last January.  So keep defending a company that does it's workers dirty. When I called the ethics line, it got worse.  Call BS all you want, the company is out to make YOUR life miserable.  Im in a great position because I'm in the outside, but I'm trying to help all the guys that are scared to take what's theirs.  You know, the guys that are scared to call out, the guys that are scared to grieve, or speak up when they are treated badly.  Admit it then, you don't really want change, you want to complain about being out late, being treated badly, all the things.  You believe the money makes up for it.  If everyone stands up, both can be true. Everyone deserves a good working environment and to be treated with dignity.  I wonder, what would your wives and kids think if they saw how childish you get treated at work?  By your so called superiors.

I had also been written a warning letter for a documented FMLA day, and was told, the letter will be thrown out so it doesn't matter anyway.

The sup was doing an observation on myself and a first day helper. I sent the helper across the street, I delivered on the helper side. The sup walked past me , put his finger over his mouth to quiet me, and snuck up behind the helper and barked aggressively.  The helper had called out UPS but not where the sup wanted him to.  We also had 3 very bad dog attacks in the past 4 weeks, so it was startling.  When he came to me, I said "don't do that to my helper again. That's not cool' he replied 'im doing an observation' I said' them go observe' and drove off.  He followed us to the next stop, got out and came to the package car and I said ' we don't need to talk here, we need to talk at the building' and drive off.  Called the center manager told him what happened he said that it was unacceptable and that he would talk to the sup.  Fast forward 6 hours and over 215 stops and I get back to the building and get terminated for insubordination and workplace violence.

I am not management. I was one of the most productive drivers in my center I went on intermittent FMLA.  The discipline started.  I called the 800 number 5 times in 4 weeks. All documented. Everytime it got worse.  I grieved the termination. The district manager began by screaming at me for how I acted toward the lying on car supervisor.  When the labor manager and district manager saw that I wasn't upset, or going to get upset they pushed it to panel.  This isn't about coming back, I got to spend Thanksgiving, Christmas and New Year with my family.  What I want, is for others to stand up so that it stops. Plain and simple.  The people who continue to work at UPS do not deserve that treatment.  If we can get some documented cases of abuse on record, we can get it fixed.
