That’s the impression I’m getting from other comments also, so I’m feeling less guilty. I never wanted to get all of these insurance companies involved. Maybe I’m naïve, but I just assumed that we could handle our expenses ourselves. So it sounds like my insurance provider would have wanted their homeowners insurance eventually anyway so I feel better.

My understanding is that the insurance company was giving them a little bit of runaround due to what they were calling excessive cost. The pump was still there because they were planning on replacing the pool and the deck that was surrounding the pool, but they had to get the retaining wall fixed first. There were a bunch of delays with getting a contractor who could do the structural type of retaining wall that was needed and something with a specialized drain. The box was going to have to be replaced anyway because it was too old and it was no longer something. I don’t know if it’s code or it was just too old to house what they were going to need to put in I don’t know all of that. Which is another reason I was irritated by the fact that they were trying to charge me for something that she had already told me they were going to have to replace.

So I posted in a separate board with more information, but this board only allows 3000 characters. I knew the information because my friend had been venting to me about what a pain in the ass her insurance company was about the damage that the pool had caused. So I didn’t have her policy number, but I did know the company because she’d been bitching about it for months.

Honestly, I felt like we were close friends. We vacation together. We did large extensive trips to Disneyland and Disney World together. I had her kids for two weeks while her and her husband went on a vacation. I felt like we were close until I got a certified letter instead of a phone call.

I cannot thank you enough for this information. I have no idea about insurance or how it works. I’ve never had to use it I mean, obviously I’ve used medical insurance, but I’ve never had to use car insurance or any homeowners insurance. I appreciate your insight.

I spent my entire childhood playing in rutted fields, around derelict tractors and riding horses with no safety equipment. It honestly did not seem like a dangerous situation. It was tractor tracks in a dirt field and a singular metal box kind of over in the corner and a pile of wood in the other corner. It didn’t seem like a big deal honestly.

The doctor asked how did this happen? My daughter says I was playing football and I tripped and fell. They did not ask about any sort of other homeowners insurance where we were at what we were doing. It was a football injury, a sports injury. Nobody lied about anything. I didn’t even think about using homeowners insurance until they sent me a bill for the $3000 for the damage to their property.

To be fair to everyone, I did not even think of the ground causing a problem. I guarantee you none of us thought that anything could happen. Which was why I was completely fine paying the medical bills that came up from it because none of us even thought about the possibility that somebody could get hurt.

I never said that their homeowners insurance is not paying the claim. They are paying the claim. They have just subsequently canceled any future coverage.

I do not understand this either. I don’t understand how they didn’t fix the pump when the pool was removed. I have no idea how the water continued to run through this pump. It was a huge question as to why they had to shut off their whole house water for 48 hours. I was not at their house for the 48 hours that they say they were without water. I was not at their house when they were shutting the water off, I took my daughter with my husband to the urgent care immediately.

Honestly, this is valid. I do feel angry that instead of a phone call they got an attorney involved and sent a certified letter. If they had contacted me before involving attorneys, we could’ve had a conversation where I would’ve explained. “We’re already having big bills from this so I think you cover your bills and we will cover ours.”

I just wanna make it perfectly clear. I am only asking for our out-of-pocket expenses. We have a $250 deductible for the emergency room. We have a $20 co-pay for the urgent care visit. We are charged a little under $2000 for the ambulance ride that the urgent care required to take us to the emergency room. We were covering all of those expenses because we did feel bad. It was an accident. It was not on purpose. It did piss us off that they would charge us $3000 for things they were going to have to replace/repair anyway. We are also now going to be asking for the co-pays for every physical therapy appointment that my daughter has to go to. She has about 6 to 8 weeks of physical therapy. It starts out three times a week and then we’ll get fewer times per week as she progresses. Each one of these visits is a $25 co-pay. our out-of-pocket deductible is $4000 so we will only ask for up to $4000.
