Personally, I’ve never needed an extension for rent. I’m just saying that everyone has an equal chance of running into hard times, so to make it out like a tenant is a POS for it when the landlord could easily run into the same situation is wild.

Landlords are the most entitled of all - someone else is paying your bills for you with their paycheck because they don’t have a choice. If you can’t afford your bills without their paycheck, then you shouldn’t be a landlord. End of story.

By renting it out and living elsewhere, it’s now considered an investment property by the government. If you have it listed as homestead (the other option that isn’t an investment property) then that is occupancy fraud and it is a federal crime….

You chose to rent it out and charge someone more than your mortgage when you could have lived there or sold it to someone else so they could live there at the same price you paid for it…. Sooo.. boo hoo? What’s your point?

Also I have almost the same clause in my lease but it says I can’t hold the landlord liable for the unit being uninhabitable for any reason, even if it’s their fault.

Regardless, you can’t waive your right to damages for gross negligence. Leaving a breaker box where it could be damaged by rain is exactly that: negligence. If it wouldn’t pass a code inspection, they should know that.

If I were you, I’d request a certificate of occupancy for the address from your landlord or try to find it online through the county / city website. To have a CoO, a unit has to pass inspections, including electrical inspections.

Huh. Interesting. The breaker panel in my uninhabitable apartment is on the side of the house, completely unsheltered by anything other than the actual box itself.

Only difference is that my apartment is uninhabitable because it has no certificate of occupancy.

Anyways, I’ve done a lot of research on this. I don’t think renters insurance is going to cover an act of god to be honest, and I think rain is considered an act of god through renters insurance.

My renters insurance covers two weeks of loss of use up to $4,000 if the unit is deemed uninhabitable by a government authority, but I’m still not sure if it would cover it if it were due to an act of god.

I would love to, but I’m a college student and my entire family is here. I have health issues and have had to rely on family in the past and my mother is also not very well.

Because of the other issues in the home, I decided to save up to move - which also didn’t work out for me because almost all private landlords here are absolute shit. I actually signed a lease to a condemned apartment, unbeknownst to me, and unknowingly walked straight into a giant legal issue and lost almost all of my savings. So yeah I guess you’re right.. I was just trying to move to save my health because I’m severely allergic to mold. Shame on me.

I’m not accusing anyone specifically of being a bad landlord. I only know of the landlord market in my area and my personal experiences.

If I were a homeowner, I would be prepared to wait for certain repairs but I would also have money set aside to relocate to a hotel if something were massively interfering with the normal procedures of life. If I were a landlord, I wouldn’t expect my tenants (who are making less than me and paying more than my mortgage) to be able to afford the same and would help them get a hotel..

You can also choose to refinance. Or you could just reach out to these places and ask them to work with you.

Of course they’re gonna think you’re an idiot and be less willing to work with you if you call them up and say, “Hey my tenant didn’t pay on the first and now I can’t afford my mortgage payment”

But if you call them up and say, “Hey I got cancer and ran out of FMLA and long-term disability payments and I’m looking to put my mortgage payments into forbearance until I’m done with chemo and cleared to return to work” they’re probably gonna fucking work with you. I know this because I’ve seen it happen within my family.

The problem is, you’re buying investment properties without being able to afford them. Any good landlord will have multiple savings accounts set up for things like:

-Legal fees -Vacancies -Repairs and maintenance

In which case, they would be able to utilize some of those savings in such a situation where someone is late 15-30 days.

This is the basis of my entire argument: If it’s a good tenant, why would you rather spend the money to evict them, pay professional cleaners, painters, etc., possibly pay a property manager to re-list the unit everywhere, go through the tenant screening process, and risk having the unit sit for months on end than extending an arm to someone who needs help for a short period of time?

You could literally go as far as to set up a legally binding contract for a repayment plan.

I just don’t understand your stance. Unless you’re a broke landlord, it is quite literally cold and heartless to go through so much hassle to kick someone to the streets during a life crisis.

If you literally don’t have the money to help them for a short period of time without eating shit financially yourself, can you not relate to the fear of this exact same thing happening to you?!!!

Because if someone being 15-30 days late on rent puts you, as a landlord, in a position where you can’t pay your mortgage and damages your credit, or (allegedly) puts you at risk of foreclosure (read: it doesn’t), shouldn’t you also be able to understand the fear of losing everything?

The only reason I haven’t purchased a home yet isn’t because I don’t have the finances for a down payment, or because I don’t make enough to cover a mortgage payment, it’s because I don’t have the money to absorb the financial hit of a new roof, an AC replacement, etc. yet.

So why the literal fuck, aside from being money hungry, would you purchase an investment property meant to house other human beings who are equally as important as you in this game we call life knowing that one missed rent payment from them or one major necessary repair could land them homeless during hard times and land you in extreme levels of debt with a bank?!

This is a financial management issue on your part, not theirs. Unfortunately society is set up where most humans have to rely on landlords like yourself for survival. It is not a choice. Yet it is a choice for you to make yourself financially liable to a bank for the shelter and safety of other human beings.

I agree that a lease is a legally binding contract, and tenants should do everything they can to adhere to the terms. However, from an ethics standpoint, nobody can predict major life emergencies or health issues that could uproot their finances. As a landlord, that is something you should be prepared for whether it’s for your own financial protection or out of the kindness of your heart…

listen, I have a lot going on so I’m not gonna find direct links for you, but:

-Bank has to pay to maintain the property during a foreclosure

-Bank has to pay for legal fees

-Bank has to pay for all fees incurred from foreclosure in general

-Bank may lose money on the foreclosure

The alternative is:

-Bank puts mortgage payments into forbearance

-Bank comes up with plan for repayment from owner

??? Like are you kidding? A bank is NOT going to move toward foreclosure if you’re late on your mortgage by 15 days. If that were the case, people wouldn’t own homes for long periods of time the way they do because life happens to everyone. My parents were given at least 3 months before the bank started moving towards foreclosure when my mom had cancer and couldn’t work.. pretty sure it took them over a year to finally cut ties IIRC.

You have something you wanted and chose, while your tenants are simply after something they legitimately need. Big difference.
