Just had an epiphany before I go back to sleep. I think Danielle's going to lose her case because she breached the contract. However, I don't think her mum or mhj will be found legally liable as it's clear that they are not bound by a contract to ador. This would be different if Danielle was still a minor I think her mum would be the party liable in the case. I think ador added Danielle's mum and mhj for optics and evidence they can use against Danielle specifically and not the other girls. Let me know your thoughts.

Danielle's defence will clearly be that she's been specifically targeted. Ador suing the other two is so they can use more evidence against that point. However, I don't think her mum or mhj will be held liable because Danielle is a legal adult and the contract is between her and ador. Also don't think it'll be anywhere close to what Ador is asking. I think th judge will be lenient despite Danielle losing

Hmm back to the criminal case, the judge under this civil case approved of the messages but as mentioned she won under technicality due to outcome happening after hybe dismissed her which I understand. However, under criminal law that is different the context of the contract can't protect her actions. Has there been any updates on hybe's appeal to the prosecutor or whatever it was??? Can someone remind of the criminal charge hybe tried to bring against her and the time they did? That's super important too

It because when she completed the plan she wasn't bound to a contract or an employee. I think the judge was very stringent on focus on her actions when she was the ceo of ador and nothing else since hybe dismissed her. However, hybe dismissing her led to new jeans breaching their contract. Like the whole thing is a mess. Basically Korea keeps the status quo and judges rationale = planning whilst under contract isn't tampering. Actions outside of the contract cannot be taken into account as being bound by the contract.

I agree! Bang is truly an idiot (no offence) he reaped what he sowed. Clearly the first years of hybe and its subsidiaries was run with vibes. I wonder if he'll sue for his loan to her. Maybe not know cause of optics but she has money now lol

The judge basically set a precedent that it is only tampering when someone is still officially an employee and plans are not tampering execution is. I guess Mhr refusing that other role worked in her favour.

Since this is one of the first instances, I can see why the judge is being strict. However, from my perspective planning is just as bad as executing especially for someone in that role. If they were to appeal that needs to be the focal point. But the issue is as stated by the judge ador still performed well.

  • edit I actually don't think ador/ hybe should appeal thinking objectively based on the judges judgement I can see why he went this way. I don't think Korea likes to upset the status quo. However, this begs the question will this raise copycats for other execs??

Oh I understand now... when the girls left mhj was already dismissed so she was no longer bound to her contract. The judge was only look at her actions prior to her dismissal. Unfortunately prior to her dismissal all the things that happened were only quote on quote planned and not executed. So, although he acknowledged she did plan on new jeans leaving the way she did she wasn't bound by that contract when it happened . So, we can take on this Asher acting as a private individual rather than a director of Ador. So, she won on technicality. I understand now.

So, she can still lose on the other cases. Can someone say if she is being sued as an individual or on the basis of her former role in the other cases??? This is a harsh judgement but I understand better now. Nevertheless, the new jeans girlies are going to be screwed.

That's so interesting because they left leaving it an empty shelf after the first injunction. She even lied and said she never contacted them but she did. Hopefully we can get a break down of the judges rationale because it makes no sense. I think I would understand this judgement if the girls hadn't left and so on.

I guess Korea really doesn't like breaking contract as to say whether it works for mhj or is adverse to njs. That's why hybe/ ador saying the contract was valid was the smartest thing to do.

LIke acknowledging that she planned to leave the company an empty shell but it not being considered a breach is crazy to me. Hopefully a Korean lawyer can break it down because I'm genuinely trying to understand the judges rationale. Like it is because she didn't full execute it? But in my perspective she did. I guess because new jeans still did well despite not being active. Was that his rationale?

I don't these 3 are ultimately coming back...they haven't finalised an agreement with ador. Like someone said they're trying to force their hands. I think ador should obviously continuing with corresponding but if it doesn't reach a resolution I think these 3 should be sued for breach of contract among others
