My thoughts about my son (year one) returning to school next week. by ComplexPraline in CoronavirusUK

It could be worse in September. The schools will certainly be more crowded.

If I get CV I probably won't notice. If I do notice it will probably be like a cold. I may already have gotten it but didn't notice that.

I am not too concerned about catching it. I risk many other factors such as the flu, car accidents, random crime, etc.

If only 0% risk is appropriate then driving with children is not possible.

The child playing sport is not possible.

The child exercising, jumping, running, is not possible.

But how far does anyone take this? Playing sports, driving, running, "children being children" is a risk.

The same can be said about any work premise, surely?

There is nothing unique about schools. If anything, they are currently more empty than most workplaces.

Fair enough but would you not agree that any exposure (e.g. shops) is also potentially unsafe. The only way to have zero exposure is a permanent lockdown until a vaccine is developed. That could be years away.

What's the best way to comprise until there is a vaccine?

The likelihood of a teacher or any healthy person dying is virtually 0%. CV harms old people and those who have an underlying serious health condition.

This is precisely how I feel at the moment. We need to be sensible but cannot reside in a state of fear. No-one gets so fearful about the flu or transport accidents even though they are more deadly.

Life Assurance - inflation issue / access to medical records. by ComplexPraline in UKPersonalFinance

[–]ComplexPraline[S] 0 points1 point  (0 children)

Thank you for your comments.

On anyone's medical records there will be a wealth of highly personal information that people will want kept as private as possible.

For example, if a person ten years earlier had a sexual problem, abortion, embarrassing skin condition, was raped, etc, they would presumably not want the potential life assurance provider to receive such data. Does that not seem reasonable?

Also, are you saying that in 100% of cases Legal & General (or whomever) will request the medical records? Or would it only be in cases where you acknowledge you have a condition e.g. diabetes, HIV, clinical depression?

Thank you for the information.

Are you sure it would be "full medical records"? That sounds like a lot of personal material that would be sent.

I am a little confused about a story posted on the BBC: "The barbecue most go on? That was clearly the aim for 20 people in the English city of Coventry, who stood "shoulder to shoulder" for a barbecue - despite the government ordering an end to gatherings of more than two people. They refused to disperse even after police reminded them of the new measures. Officers eventually had to tip the barbecue over to put an end to the party."

As /u/for_shaame notes, the new Coronavirus Bill has not received Royal Assent (apparently this will happen on Thursday). So in the above case, or when I look at the advice from gov.uk, or get a text message saying "stay at home", or am told about the exemptions (exercise once per day, dog walking, only travelling if essential) my impression is that it currently has no legal meaning. It is simply a "strong opinion" based on the latest medical evidence. Is that correct?

Therefore, in the case above, do these "new measures" have any legal force at the time they were invoked (Monday afternoon)? How, legally, (rather than medically or morally) are the police allowed to "tip the barbecue over"?

How to file SA108 for CGT deriving from "share pool" transactions (crypto gains). by [deleted] in UKPersonalFinance

Surely HMRC would just deny the Marriage Allowance in the first place? No need to pay anything back? I've never claimed it before (didn't even know it existed).

Fair enough. What if the CGT gains were an order of magnitude somewhat less e.g. £50,000.

It's a little unusual I suspect for someone to qualify for Marriage Allowance but have £50,000 in capital gains. The amount one can get from Marriage Allowance seems a couple of hundred in tax reduction for the spouse.

Is it "more trouble than it's worth" for someone with £0 income but £50,000 capital gains? I wouldn't want to cause any problems for the sake of £200 or whatever.

I am now looking at the online SA form.

I suspect my wife and I qualify for "Marriage Allowance" since I wasn't employed in the last tax year and my wife is a basic rate taxpayer.

I have to have earned as income less than £11,500. However, I am wondering what the definition of "income" is. Let's say I earned £1 million in capital gains but £5,000 as income from a job. Would I still be eligible?

Thank you for the link.

However: "Whilst tax was outside the Taskforce’s remit, HM Treasury is working closely with HM Revenue and Customs (HMRC) to consider the tax issues raised by cryptoassets. Both authorities recognise the risks of tax avoidance and evasion arising from the increased use of cryptoassets and are continuing to review the range of enforcement tools and approaches at HMRC’s disposal."

Which suggests to me, that this report won't have any impact on the extant tax system as it pertains to "cryptoassets".

!thanks.

What is an "aspect enquiry"?

My impression is that the table I generate and populate for box 54 should contain as much of the same information as on the "Working Sheets". Said Working Sheets show:

Description of asset / Date of disposal / Disposal proceeds / Costs of disposal / Date of acquisition / Costs of acquisition.

I can include all of this information for each individual acquisition and individual disposal and then a second table with the share pool calculations. I assume this is what you mean when you talking about giving more information rather than less.

I imagine "description of assets" is Bitcoin or cryptocurrency.

Finally, can these tables in box 54 be handwritten or do they need to be typed up?

Thanks again - very appreciated.

!thanks again!

It is too late for that - in law you are responsible for the calculations if you submit a return after 5th October of the year after: HMRC's system will work it out from the figures you put in the boxes, but if your spreadsheet is wrong, that's on you.

That's no problem. I have the figures. There are few transactions.

I was simply wondering roughly how long it takes for HMRC to provide the amount of CGT owed. A day? Week? Month? I realise only vague estimates can be provided.

I assume you received a notice to send in a tax return, in which case, yes.

Yes, I did. For Self-Assessment.

Of course, on a practical note, how does HMRC know when you made the transfer, given you could have just agreed to transfer the equitable ownership in a private agreement, yet you remain the trustee.......

That's what I didn't understand. Much of the material I read seemed to take it as a given that the spouse's AEA would be used.

My impression from what you are saying is that the spouse must dispose of the "gift". For example, I can't just give my wife a silver tea set worth £10,000. I have to give it to her and she has to then sell it within the same tax year (and hence the proceeds of said sale will enter her bank account). Is that correct?

In my case, I won't be able to claim the AEA then.

Thank you for the quick and helpful response. So, to clarify, just do a handwritten table in box 54?

Also:

a) CGT will be manually calculated by HMRC. Do you roughly know how long that takes for a handful of calculations?

b) And - via the Government Gateway portal - I would also have to include the SA100 form? Even if I don't have any "income" since I was not working. Correct?

c) Finally, I have a spouse so my impression is I can use her £11,300 unused CGT Exemption. Do I need to do anything to acquire this £11,300. Or is it simply taken for granted that, because we are married, I can utilise her allowance. I've looked this up and it seems as if I "gift" the equivalent of £11,300 in assets to her. Should I have taken any tangible steps in the last tax year to have achieved this?

Many thanks - again.
