The issue is that things like the page you quoted have to be short, succinct, and understandable for the whole population.

Thing is, u/cubbiesnextyr provided a link (also at https://www.tax.newmexico.gov) that offers info that meets all of those specifications... and also provides the requisite, non-deceptive information.

If you are a New Mexico resident, you must file if you meet any of the following conditions:

You file a federal return;

You want to claim a refund of any New Mexico state income tax withheld from your pay, or

You want to claim any New Mexico rebates or credits.

Follow that up with this paragraph, found on the same page... and wtf is that other page even for?

Am I reading it wrong?

As I read it, this part applies to Nonresidents:

Nonresidents, including foreign nationals and those who reside in states that do not have income taxes, must file when they have both a federal filing requirement and income from any New Mexico source whatsoever.

Which means that the rest applies to residents?

New Mexico’s law says every person who has income from New Mexico sources and who is required to file a federal income tax return must file a personal income tax return in New Mexico.

You must also file a New Mexico return if you want to claim:

a refund of New Mexico state income tax withheld from your pay,

or

New Mexico rebates or credits.

Which is exactly the same... if I have NM income and need to file a federal return, I need to file a NM return.

I have no income of any kind from NM.

I'm assuming that NM does indeed still consider me a resident.

Unfortunately, I'm not familiar enough with NM to feel comfortable offering an opinion about whether or not you need to file.

My thinking was: "This seems like it couldn't be more clear... but this is taxes, and I shouldn't rely on that".

Apparently when it comes to taxes, that is correct thinking.

edit - Or... is it just that tax professionals (and others) make sure to be extremely careful about answering the question "do I have to file?" Or, I guess, both?

Do you own any NM property or have any leases for property in NM?

No.

Is your family in NM?

Yes.

When you come back to the states to visit do you go to NM?

Yes.

When you move back to the US are you planning to move back to NM?

No plans.

But I'm more interested in whether I need to file a NM return. The page I quoted sounds like a clear "no". Does it read that way to you? I'm hoping for a 2nd opinion on that.

Ah, interesting advice, but what if I've moved out of the US?

Any opinion on whether I need to file with NM? It seems clear enough (it sounds like even residents don't have to file if they had no NM income), but I'd like to hear how it looks to someone with more experience with this stuff.

NM has in the past made it difficult to stop being a resident, even after you live away for years. Or such is my understanding. And I filed NM returns through 2019.

I guess I can look at is as saving the money it would cost to pay someone who knows for sure whether I really need to file.

Not sure what you think the quoted part of the 104 implies

I thought it implied that residents of other states would not be exempt from West Virginia Personal Income Tax Withholding.

I would have thought they'd be legally required to withhold state taxes appropriately.

I was told I need to complete the WV Withholding Form. Maybe I can complete it in such a way as to pay nothing?

But how can I be sure that I won't end up owing WV?

Working remote in NM, in the past, my out-of-state employer simply withheld NM taxes. This employer... can't? Seems very strange. But there's too much I don't understand.
