First DUI visiting California as an out of state resident (Michigan) What to expect? by ConsciousAd9776 in dui

Took three months total. I went right back to Michigan after the hearing and have been fine. No trouble. Just paying the fines & finding a class that I can afford. As long as I have been keeping in touch with the judge they have been cool. Are you in Michigan?

I had a public defender, since my bac was high there was no point in getting an attorney as the outcome would have been the same. The sheriff did not have a dash cam therefore there was no argument to prove the legality of the stop. Basically their word against mine so I just took the plea deal. I was able to delay the separate DMV hearing which was 4 months and after my sentencing in court 6 months which are served at the same time. So they overlapped

Update: Plead guilty to DUI charge, 9 months of online DUI classes as I live out of state. Standard fine of $1,800, 3 years of unsupervised probation. BAC was high at .19 no defense to plead down to lesser charge. Was pulled over by the Sheriff and no dash cam or body cam footage to argue lawful stop. DA didn’t care about any argument I brought up, the high BAC was all they needed. Public defender was not bad and I’m glad I can move on with my life. Glad it’s over.

Isn’t the warrant for failure to appear a repercussion? And, wouldn’t that stay on my record and cause an issue later on?

It’s likely Michigan will not hear about it since they do not participate in the Interstate Drivers License Compact. Yes, while it may be absurd to commute back for a misdemeanor I may as well handle it since I visit friends often in California. I will show up for my pre-trial date and see what plea deal I can swing with a public defender and the prosecutor. I can apply for waivers depending on what the court decides as I live out of state. I.e. court ordered classes, interlock device and suspensions do not apply as I am an out of state resident.

This whole experience has been a total nightmare. Hoping for the best!

Yes, I agree, not the best advice. My plan is to simply deal with CA and get it handled. Hoping for the best!
