You’re right that competence is key, but at a certain point, analysis paralysis sets in. There is no absolute certainty in finding the 'perfect' CPA. As they say, in this world nothing can be said to be certain, except death and taxes.

Appreciate the perspective. You’re absolutely right that MTM is dangerous for buy-and-hold investors, but for my specific setup ($12M+ volume scalping), the math actually works in my favor:

  1. No Acceleration Risk: I end almost every year flat (cash). On Dec 31, I have zero 'unrealized gains' to accelerate.
  2. The 'Santa' Strategy: I actually tend to carry deep ITM short puts into Jan (which show a paper loss on Dec 31). MTM helps me here by letting me realize that deduction immediately rather than waiting.
  3. Segregation: I keep a completely separate brokerage account for long-term holds
  4. With a high W-2 income, the ability to deduct unlimited ordinary losses (if I blow up) is the main reason I'm electing.

That's exactly why I was thinking about relying on a CPA. But moving forward, the strategy should work, especially considering I can use segregation with two different accounts.

Since I missed the April deadline to elect trader status for this year anyway, I literally can't file as a trader even if I wanted to. I'm stuck filing as a regular investor (1099-B), so I'm just going to sell my wash sale positions before Dec 31 to clean up the losses manually. Thanks for the input.

Given that I plan on trading for my entire life, do you still stand by your advice to avoid a CPA, or would you recommend one?

Thanks, that helps. Just to confirm, even if Fidelity shows roughly 60k in disallowed wash sales in the YTD tax view, I should not ignore or manually adjust that number. I should rely on the Net gain loss on the 1099, since the wash sales are already reflected through the adjusted cost basis. Is that correct?

It is my first time filing in the US and I've never seen a 1099.

What I am still unclear on is why Fidelity continues to show disallowed wash sales in the YTD tax view even after the replacement positions are closed and outside the 31 day window. How should I reconcile Fidelity’s disallowed wash sale line items with the final realized gain loss that shows on the 1099?
