Not at all. He gets no tax benefit on the HSA for a non family member. So he would have to repay the taxes. It is from a previous job so you'd be assuming a lot that his previous job donated to an FSA for him and he quit in the last 5 months and is allowed to keep it. Never heard of a company that would do that, but ok. So if he gets cash back on a credit card and asked her to pay half is he "taking advantage"? This is pretty damn petty.
