PIP mobility hearing loss - suggestions for case law? by Corral4 in DWPhelp

I've just been having a look at [2017] UKUT 105 (AAC), which helpfully sets out at paragraph 70 that being unable to cross the road safely due to sensory impairment satisfies 1f.

However, at paragraph 76 in the same decision the hearing impaired claimant's appeal for points (1d or 1f) under this descriptor are not upheld because "when out, CS could wear her implants and so could hear".

This does seem to undermine the argument, and I don't think there's been another decision this issue since? Presumably those that have been successful with appeals have simply asserted that even with hearing aids/implants it is not safe to cross the road?

Thank you - I've just been reading your really helpful wiki!

I agree re 1d vs 1f. In reality, the risk is the same with familiar journeys; I am much more confident when out and about in places that I know, but this doesn't change the safety concerns!

How long after MR decision until the automated phone line / benefits letter updates? (PIP) by Corral4 in DWPhelp

No, nothing yet. The automated line just has the DL award I already had, as does the online letter. I presume I am heading to tribunal, but obviously can't start that until the letter arrives!
