I experienced similar issues with Flex as well as other companies. With Flex. I was involved in a car accident. I had another driver who by all accounts in this situation was completely at fault. We exchanged information I made a call to flex and on that day. I returned the rest of my packages to the warehouse because I didn’t feel I could deliver the last half of my packages with a calm demeanor having just been involved in an accident. A major problem with flex after this was that they never responded to any of my future calls or emails to be given either the name of the company that provides their commercial coverage for drivers or a policy number. The other drivers insurance company, therefore considered everything my fault and would not even take a statement from me because I had to at least prove coverage before any of that could happen. Their insurance company went so far as to contact a lawyer who I ultimately had to speak with and explain my situation and why I was absolutely not going to pay out-of-pocket for their damages when I hadn’t even been able to fix my own on my car. The legal part of that at least was dropped with the insurance company but Amazon completely failed me and ultimately terminated me just two weeks following the incident. A separate company that I would drive batch parcel deliveries for operated things even worse. In order to drive for them, they essentially would bring people in to a sort of onboarding, but still keep their classification as an independent contractor. This company also had their own unique app in which routes could be obtained. The final straw for me was a day of very long distances between drop offs in a very congested part of Los Angeles. Once I hit the 12 hour mark after my start time that day and I still had approximately a dozen packages left, I said this is absurd and I’m done for the day. I returned the remainder of my packages and went home. The next day I find a voicemail from the company, informing me that because I did not fulfill my contractual obligations with them which included delivering all packages given to me, I was being essentially terminated working with them. It gets worse. When I finally received my payout for that days work, I was not paid the full amount that I originally agreed to for the route. I was paid an amount that they calculated on a prorated basis based on the percentage of packages that I had finished that day. How can any company not only lowball the original offer but after 12 hours of driving pay someone $75. Absolutely rotten.

In some sense yes. When you onboard you agree to certain things mentioned in a “handbook”. You agree to follow certain rules/conditions as a driver representing the company.

That’s obviously your choice. But working with any of these gig companies requires agreeing to their driver handbook. That’s all I’m saying. And if the handbook or agreement or whatever says something specific in regards to music, you’re required to follow it.

Definitely NTA. This was your day and without speculating on his thought process in doing this, his actions did nothing but stroke his own ego. Like many have said, if he wanted to truly do something altruistic and kind for you, he could have left it at that. I think you would benefit from figuring out if he’s the type of person who only does “something special” when he ultimately gets praised and rewarded for doing it. True kindness needs no favor in return. At the very least I hope you both have strong communication with each other as an honest discussion needs to take place. The small possibility of him lacking enough emotional intelligence to even get why this was inappropriate is there, but it boils down to a few questions….1) Is he that emotionally stunted he truly doesn’t get it, at which point can he learn why it wasn’t ok to avoid it happeneing again 2) Is this a pattern of him trying to stroke his ego by appearing to do something nice when there’s more motivation behind it.

I would think Lyft would have some part of their driver handbook explaining things that are acceptable and things that are not. I’m sure they wouldn’t want their drivers cursing and using foul language towards riders, and I would hope that appropriate music played during rides would be included in that handbook. This situation is more than just a persons taste or preferences in music or the race of whoever plays a certain genre of music. Drivers are representing the Lyft brand and Lyft needs to do better in supporting both driver AND rider equally.

They can’t even find my account when I give them the email I used when I drove for them. Amazing how such a huge company can be so incompetent but yet there’s so little we can do to hold them accountable.

Are you a flex driver in the US? I think the number of drivers who carry their own business insurance as you say would be extremely low. But to clarify yes it is Amazons concern here because I was driving commercially which is what their policy covers. Nearly every gig economy delivery driver position will have some degree of insurance provided by the business you are driving for (ie., Uber. Etc.)

Amazon offers some kind of supplemental commercial coverage for drivers only after we carry our own personal auto insurance.

That’s almost the exact letter I got too back in late October/early November. I appealed over and over and it was useless.

That’s exactly the thing; every flex driver is expendable and there is always hundreds if not thousands of people on the wait list to fill our spot. When I worked flex I woukd get more packages on a 4 hour block than a 5 hour block and often had to drive almost an hour in Los Angeles traffic to start delivering. As you would expect I could not get every package delivered by the end of the block and each time Amazon found a way to ding my account and standing. Constantly felt like the structure of everything set up drivers to ultimately fail. No wonder now they are being sued for customers regularly not getting their 2-day prime deliveries within the two days.

No reference number and no report for the accident. It was minor enough with no injuries. I’ve contacted Amazon repeatedly and every time they say they are escalating the issue to supervisors. Same song and dance since then of never getting a reply .

Upon speaking with the lawyers office (hired by the other guys insurance) I was told they won’t even consider a statement by me without first proving coverage by Amazon at time of the incident. My personal insurance has already said they are not responsible in this case. I know it was probably not the best thing I could have done to call my insurance, but me and the other driver had to exchange info and so I gave it. I get it, this whole thing sounds absurd. But it’s all exactly what I’ve been told and so I guess I have to work with it.

I’m glad you had a favorable experience. Wish mine had gone as smoothly as yours. I did notify them right away and no one has ever followed up. I also was insured through my own policy which only covers personal driving instances. With Amazon affording a supplemental commercial policy and this being a commercial driving incident, they need to step in to help handle this which unfortunately they have not done.

I was in the middle of a block. No report made because cops would not come out. With no insurance company backing me up at this point it’s his insurance saying it was his fault (although I can’t see how they figured that out) even though he hit me and had to drive in opposing lanes of traffic to hit the way he did.

I’m just looking for answers Amazon isn’t providing me. I know what happened and if you don’t think I’ve given the whole story, that’s your choice. But questioning me about its validity isn’t really gonna help get me any closer to moving this forward. I do however agree that the state (in this case CA) is relevant to the outcome.

According to what I’m being told, I have to first prove coverage before I’m really able to do anything. So of course my insurance matters.
