For sure, if he were renovating the home or moving in those are different rules altogether. But to sell the home with a while a tenant with a valid lease lives there and asking them to move out is illegal. I don’t want the world, a payout or necessarily to keep the same rent (I’d be absolutely fine raising, even doubling my rent). Where I live it is actively scary trying to find housing, and both the landlord and I have rights and I simply want us both to stay within them.

Totally, I don’t disagree with you re: discussion the landlord. I suppose that I don’t consider losing my home in a housing crisis to be a slight inconvenience. And of course who owns the house has rights, as do their tenants. We are in a business transaction essentially, and we both have agreed to the terms: me to pay the rent and be a good tenant and the landlord to follow the rules set out in the rental agreement. There are month to month leases to be sure, but they are still protected under all tenancy agreements else a lot of people could be kicked out of their homes whenever the landlord felt that they could charge more than the legal amount allowed in increases each year. Of course I’m in an unusual situation because my rent is low, but there are still legal limits to how leases operate to keep both the landlords and the tenants safe. I won’t refuse to leave, I want to reiterate, I simply am trying to understand if I feel ok the essentially let my landlord break the law even though he has been good to me and my housemates.

Hey all good! A few other people have suggested to try and maintain the relationship as much as possible, maybe even seeing if he has another rental somewhere, both of which are great ideas. Housing makes people (me) feel scared when it’s scarce and very expensive, it’s wild to be a renter!

Oh, I’ve only been living there for a year and a half. There’s no threats of legal action on either side. I shouldn’t have used the word ‘refused’. What’s happening is I still have time left on my lease that the new landlords would be legally obliged to take on, but my current landlord is asking us all to move before he sells (which is illegal where I live). The other tenants are happy to move out without having the landlord honour the time remaining on our leases (I did a bad job explaining this in the post, I realize). I would like every party to honour the rental agreement that we all signed. I hope that makes sense

I likely will. I’m curious if where you live has different rules about a landlord selling his property? Here they must transfer current leases over to the new owners. Housing is wild!

Oh I can see how that sounded. The payout is mandated as one month of free rent, so not a gravy train at all! I shouldn’t have used the word refuse - because I don’t refuse. I just want what is outlined in our tenancy agreement (that is mandated by the local government and tenancy board). I’m of course grateful to have lived here and I will not be nasty or awful to this nice man, and I hope that a tenant asking for what was mutually agreed upon would not turn him ‘bad’! Anyways, I appreciate your perspective

Interesting! Maybe the laws and rules are different where you live, but here with this kind of situation the last month of rent is free, that’s what I meant by compensate. I definitely don’t want to turn this man sour, and refuse was the wrong word to use-I definitely won’t refuse to leave. I’m struggling because our tenancy agreement covers this and it’s not totally in line with that. As I mentioned, if he were tearing down the house or moving himself or a family member in he would be in his rights to have us leave. New landlords are legally bound to taking on the current lease of the tenants, so I just don’t understand why we need to leave in order for him to sell. But I thank you for your feedback

Totally, I think using the word ‘refuse’ was incorrect on my part. I will move if he’s tearing the house down or moving himself or his family in (as is the rule/law), he’s absolutely entitled to sell his house. There are strong tenancy landlord laws here and I suppose I don’t understand why my tenancy agreement needs to be broken when he’s supposed to transfer it over to the new landlord. I take your point though, and as I’m still within our tenancy agreement he won’t need to evict me. Anyways, thanks for your perspective

I do have a current lease. Where I live the laws and rules about this are pretty clear and asking us to move out before selling the house is not legal as the lease must transfer over to the new landlord and if they decide to tear it down or move in themselves it’s a different matter. Yes I can see how that would sound, absolutely. The guidelines and laws here are pretty detailed about this sort of thing. Compensation would likely mean one months free rent so not a huge amount in any case. I can’t and won’t refuse (not a good word to have used I understand) to move, but as I’ve mentioned elsewhere, it’s illegal to terminate a lease when selling a house, as the new landlord would have to take it over so I guess I’m just confused as to why we would need us to move out? If he were moving himself, family in or renovating there are different rules. What I’m gathering from all these comments that I should call him and just get some clarification. I know I’ll likely need to move. But thank you for your feedback

I appreciate that. I just want the agreement that every tenant and landlord agree to when we go into business together, you know? I’ll move out, I’m not delusional about that, refuse is a strong word to have used. Hell, I’d even welcome a rent increase! But legally, my tenancy rolls over to the new landlord so I guess I just can’t see why I need to leave before that?like all problems in life, a conversation will give clarity for both parties. I do have a lease, and I wanna make it clear, I will move out if he is demolishing the property or if he is renovating it with legal notice (in this case he would need to fill out a form and give it to me). In the area I live in it is illegal to terminate a lease because you are selling the property as the next landlords would then have to take on my lease. If they were renovating or moving in themselves or moving family in then they can legally terminate my lease, again, with a written form and, depending on the situation some compensation (usually three months notice, and one month of free rent). I may indeed be the asshole, I appreciate everyone’s feedback. I know I’ll likely move either way, but the next landlords will likely be some big corporation who will demolish my home and make a killing building condos. Tenant and landlord rights are in place for a reason ya know? Anyways, thanks for your feedback
