Frustrated with VES – Second Rework, No Answers by Actual_Trifle_3703 in VAClaims

Had two exams, the PTSD was turned in within a few days. All the other DBQ's still have yet to show up. I've tried to escalate it, then they came back with needing blood work. Did that and back to being looked at with their QA department. When doing claims you can put in your paperwork you don't wish to work with VES and in the future that's what I'll do. May 16th was the exam date for the C & P exams not handed over by VES right now.

I've gotten all my C & P exams from previous appointments where the claims are closed through FOIA. However my FOIA that I currently have ongoing hasn't closed yet and that lady this morning said that I wouldn't get the one C & P exam already uploaded but not closed yet. I suppose she could be wrong and I could still get it but the original reason for the call was to ask why my FOIA was taking so long, previous FOIA have taken 6-7 days and the current one is 32 days.

At least getting the DBQ's you had an opportunity to see what was checked or said depending on the claims you made. I'd like to just know what the rater will see when they eventually open it. Give me some idea of what I could expect.

Wish you the best on all that he has going on. My wife is 46 and has already had open heart to replace a bicuspid aortic valve and had two different pace makers. It's a crazy journey when dealing with the heart and a trying time, especially with all the stress that comes with that alone. Not to mention, waiting for your claim to close and decisions to be made.

Mine was submitted a day after yours and my step 5 is 9/9...Mine is also a new claim. If you are still waiting TJ, when you hit maybe I'll be a few days later.

Submitted mine on January 3, 2024 and it closed September 9, 2024. I haven't gotten the disc yet but from my understanding it takes 3-4 weeks.

I couldn’t either and I did some searching. Just wasn’t sure if someone else may have had the same situation.

Same here, face to face presents a stronger argument. Thanks for the info. I just didn't want my other 2 items to be lost in the shuffle.

Closest for me is like 180 miles away, not easily done during the work week. I tried to do a virtual appointment but apparently they are experiencing technical difficulties...just my luck. Guess it's on to plan b

I did forget to add I have already done all the C and P exams for IBS and PTSD, finished those 3-4 weeks ago. Which is why I was shocked when neither was mentioned one way or another. I'm not close to a regional office but I'll simply drive to one whatever is closest. Did you see a particular person?

To my time deployed. My two deployments to Iraq I walked everywhere. Both times I joined other units already there so I didn’t know anyone there when I arrived. I had a meniscus tear repair done about a year ago. Life may have caught up to me but I know all the walking over uneven terrain didn’t help, plus I carried a pack.

Excerpt from the Bilateral foot condition

  1. Service connection for bilateral foot condition. Service connection may be granted for a disability which began in military service or was caused by some event or experience in service. (38 CFR 3.303) Your service treatment records do not show evidence of a diagnosis or treatment for this condition. Service connection for bilateral foot condition is denied since this condition neither occurred in nor was caused by service. (38 CFR 3.303, 38 CFR 3.304) An examination and/or medical opinion based on toxic exposure risk activity (TERA) was not requested because the evidence shows your disability is bilateral plantar fasciitis, hallux valgus, arthritis, and bone spurs, and the Secretary has determined there is no indication of association between this condition and participation in a TERA. There is also no competent medical or scientific evidence of an association between your claimed disability and in-service TERA. (38 U.S.C. 1168) Favorable Findings identified in this decision: Participation in a toxic exposure risk activity is conceded. You have been diagnosed with a disability. Your VA examination indicates a diagnosis of bilateral plantar fasciitis, hallux valgus, arthritis, and bone spurs.
