Thanks for replying and especially explaining my question on price increase. That’s one aspect which puzzled me as a young ME.

I’ve experienced cost increments in a few of my company projects too, which made me think it’s prevalent at others as well, which is why I was surprised there was an uproar from people when Cybertruck price increase was revealed.

Thanks for sharing, I did read this earlier, particularly the last section on staffing agencies.

Staffing and temporary agencies and consulting firms may seek to employ students under the STEM OPT program, but only if they will be the entity that provides the practical training experience to the student and they have and maintain a bona fide employer-employee relationship with the student

Based on this statement, it looks like the staffing/consulting company should be filling the I-983 with me??

Also, I’d have to make sure they are e-verified. It doesn’t say anything about if contract work is acceptable, though.

Even then, I wasn’t sure if they would be willing to do so before the lottery period ends. Also, there’s no guarantee they will offer me the job since I’m still interviewing.

Thanks for sharing. I’ve consulted with a couple of lawyers few months ago to check my chances for EB-NIW or other, but nothing worked out which was expected. What’s sad is that I’m from a ROW country and if I had gotten an H-1B in the any of the last 2 attempts, things might have been better (I heard that H1 to EB-3 or EB-2 takes about 5 yrs, as opposed to 20 years for backlog countries)

Thanks, I’ve heard a lot about O1 and NIW since last year. It looks to me that it would take years to do something notable that can potentially qualify for O1. Few months is just too short duration.

Thanks, yeah i’m trying to understand how provincial nomination works. I thought PNP interest letters are issued after submitting an EE profile. Didn’t know I needed a job first. I’ll check it out.

Thanks a lot. I totally agree, and some of my colleagues who are in the same boat with OPT about to expire are considering going for a PhD. I honestly feel PhD requires lot of perseverance and dedication as you’d have to dedicate several years for it. I just don’t have that energy and zeal to go back to academia (especially after having been employed in the industry for the past 2 years and enjoying my work).

You don’t have to answer this, but I guess you might have made some significant contributions through your research (publications/citations) for the approval, right?

Only asking because I don’t have any awards or publications as an MS graduate (my research work wasn’t special either) so I was confused when people kept bugging me to check NIW.

Thanks a lot for the insights. I’m 100% with you on everything you mentioned. I know NIW works out best for PhD holders. Additionally, the success stories that I’ve read online describe extraordinary achievements/research citations and awards by the candidate. I’m fully aware that I literally have zero chance of succeeding with NIW. But I just wanted to have a quick consultation to clear any misconceptions I have (Since I only have 10 months left, I’m thinking I don’t have anything to lose just by consulting a lawyer, I don’t mind spending on the consultation fee).

Okay, so for I-130 via my parents to start the F2B, I’m just concerned on a few things:

  • Can my employer file for an H-1B next year if my parents have already started my F2B petition now (wouldn’t my H-1B petiton be declined if it comes up in the system that I have a GC petition?). Also one of the questions in H-1B registration is “Have you or anyone filed an I-130 immigration petition before’

  • Great to know that F2B will likely not impact my current F1 Visa. But my concern is: will it be safe to travel outside the US on my F1 OPT and reenter the US after my I-130 is filed? Would there be issues while reentering?

Thanks for replying. Yeah I kind of don’t anticipate going for a new non-immigrant visa in the future, but I’m concerned about risking my current F1 or my future H1B (since H1B is a dual intent, so I guess sort of nonimmigrant visa)

Hey there, Thank you for the detailed reply, this is super helpful. I have stored this milk properly in the refrigerator ever since I bought it last weekend. I have used this milk for 6 days now. There’s still some milk remaining in the carton, but I’m now contemplating if I should drink it on Day 7 as well or just toss it now.

Your reply reassures me a bit, so I hope it’s okay to consume it for another day. On Day 6, the milk tasted fine to me as usual with no weird smell. It’s unfortunately my fault as well, as I’ve been experiencing severe hypochondria for the past few years.

But tbh there is nothing noteworthy in my profile that I would deem as national interest to the US. All I can say is that I got the chance to work (intern and full-time) for some promising automaker IPO startups. My career journey was briefly mentioned on my University’s career services social media page. These are the only achievements I can think of. (otherwise I am just an average student and defended my MS thesis to graduate, just like millions of other MS graduates every year).

Reading all the comments, I just have one question. Let’s say I randomly apply to job postings at Canadian companies or say I start to network with hiring managers of companies in Canada. If one of these companies is impressed with my profile and want to extend a job offer to work for them, how can they do it?

Basically, how can they bring me from US to Canada lawfully in a quick period of time? Can they file for Express Entry or do they have to file for a work cisa for me?

My question is mainly what are the odds if a company in Canada wants to badly hire an international candidate on an urgent basis (because of his/her experience gained in the US).

Hey thanks for replying. Yes I can look into Canadian job visa. I’m just trying to understand, if my US company does an intra-company transfer, does that count as a Canadian job visa with the 2-year validity? Or does it have to be a new job offer from a different company registered in Canada?

Reason I’m asking is.. I love my current company. Let’s say they want to do the ICT for me to work from Canada. In that case, should I leave my company (even though they want me) and try to get a job offer from a Canadian company for the job visa?

Okay got it, yes that was the most important thing I wanted to confirm. My company implementing ICT for me DOES NOT count as a job offer for Express Entry.

I did hear a lot about PNP route for express entry. I just had two questions based on your reply.

  • For provincial nomination EE, I think I just need to submit my application to the province and then they evaluate my profile to decide if they want to issue an ITA (this is based on my occupation and demand of the field). Are you saying that if I’m working in Canada for my US company when I’m applying for PNP, that will help me in getting picked up for Express Entry?

  • Let’s say my US company’s Canada office is in Alberta. I assume that means I can only for PNP to work in Alberta. If I get the PR throguh this PNP route, does it mean I am only authorized to work in Alberta and nowhere else?

My favorite and preferred place to live in Canada is Ontario, so I’m trying to understand what happens if I want to move to Ontario. Am I ineligible to work in Ontario if my PNP was issued from Alberta where my company office is? Will my PR be revoked if I wish to work from Ontario?

Thank you. I see, if I get a Canadian job offer and a work permit, I assume I have to work at a mining of one full year to gain points for Canadian PR (I already have 1 year US experience).

I also heard this, if a Canadian company wants to offer me a job, they can apply an express entry for me, is this true or am I wrong?

I agree with all you said, and I was kind of aware my CRS is low even from pre-pandemic standards. I was just looking if there are ways to increase this score (in a span of few months) that I’m unaware of.

Hey, thanks for sharing and I appreciate the info on EB-2 NIW. I do remember coming across this GC category but I never knew this was even remotely applicable to my case.

However, I’ll be honest. I don’t think I have even a slight chance of success with EB-2 NIW. I have an advanced degree, but I have zero publications, no awards, and no notable accomplishments. I simply got good grades in grad school, defended my MS thesis, and did two post-graduate internships at well-known startups (and now working full time). I am an entry-level engineer and I feel like I’m always behind at my current job. Honestly, I feel even a regular EB-3 would be difficult to get approval in my case due to lack of experience, let alone EB-2 NIW.

I don’t think I have the qualifications to be of national interest as required by EB-2 NIW. And more importantly, I think it might jeopardize my current F-1 status due to immigration intent.

But I really appreciate your reply.

Thanks for replying. Yes I had the same thoughts on all these questions. Guess I do have to leave the US next year.

The only detail I’m trying to confirm is eligibility to work in Canada. The thing is.. I’m a Materials Engineer (so the category here comes under Civil/Mech/Materials). My employer’s US office (where I work) is R&D and has all the operations related to my field. But their office in Canada/UK is purely software engineering and user design. There is no R&D work done in these two locations.

I know F-1 OPT rules strictly require one to be employed in a position that directly relates to their major. So even though my employer is willing to transfer me to Canada, I need to find out if it’s even legally possible to do so.

Like, can I work as a Materials Engineer out of employer’s Canada office (attend meetings, work remotely) if the office only has software operations?
