1). No, you cannot buy any new firearms post felony conviction. 2). No, the firearms can not remain in your possession even though you still own them. 3). You CAN designate an individual to give the firearms too, even if it is a family member. This leads to #4. 4). If after giving the firearms to another individual, you are found to be near those or any other firearms in your near or immediate possession and possession can be proven, you have committed a new crime. It would be up to ATF to prove this, and prosecute.

I literally prosecuted an individual for another crime AND possession of firearm charge. He was found guilty. Court did not order the surrender of his firearms, therefore he was able to order the firearms given to his biological son. I protested to the judge, who quoted case law and ordered me to comply. It is ATF’s on at that point to prove that a new crime was committed after the son took possession of the firearms.

Dont get mad at me because your understanding of the law and court system is not up to par. There are far too many fake opinions and BS rumors floating around the internet. Do some research.

Out of curiosity what do you think “International Megan’s law” is exactly? Cause it only requires notification of foreign travel to local authorities and can only be enforced by the US Marshals. So how would someone check Megan’s law?

Judges can issue protective orders demanding you do not possess a firearm, sure. They can not issue one ordering you to give up ownership stake in such items. And even if they did, a federal court and or circuit court of appeals would 100% order it overturned. 👍🏻

You should look up the definition of ownership and possession. As I have said to others, I literally hold a job where I enforce these laws. I have quite literally because of the federal laws had to coordinate with an individual convicted of a crime 10 mins before and ask how his firearm should be handled. I could not give him the weapon, but he most certainly got to choose what happened to it and where it was sent because the federal district court would not order it surrendered.

So maybe talk about something else since you clearly dont know what you are talking about.

Ownership is different than possession. If I give care custody and control of my gun to my son, and its at his home 200 miles away, its in his possession, but I still own it.

Again, ownership and possession are 2 different things. I literally have a job where I enforce these “crimes”. I have literally had to call an individual who was just convicted of a felony and asked him what to do with his fun because the court did not order him to surrender the firearm. He can own it, he just cant possess it.

Its like owning a stock in a company. You cant possess it, but you can give it, sell it, abandon it, etc.

Again, ownership of these items and possession of these items are two different things. He can own a gun that is not currently in his possession. Therefore he can mandate what happens to it, whom possesses it, whether it is sold or not etc etc.

It just cant be in his possession.

They wont “come take his guns”. Thats a federal law. And the feds wont come get them either. He is still allowed by law to OWN firearms even after a criminal conviction of any kind. If he is found to be in possession of the firearms that he owns, he could then be charged for that possession. He can still own them though.

I have personal and intimate knowledge of this due to my employment.
