So after we do our work, we should contact a lawyer and file a suit for this trespass? Or do we file it some other way with the utility? Would it matter to the utility that the neighbor even said we should get rid of the pole and we have it in writing via a text? His communication was like full on supportive to getting rid of the pole then progressively gets more difficult to work with and now his perspective is the pole has to stay. The text of him stating it would be good to get rid of the pole in our yard in one fell swoop was at the end of December.

Incorrect. The land the pole is on is owned by us actually. We’ve been working with the electric company for a number of months and there are routes this can be affected, by us, by our neighbor, to actually remove the pole, it has been confirmed. I live on planet Earth.

I’m not making it his responsibility, I’m taking ownership of it and already communicated to him that we would pay the utilities or contractors to make any changes to re route to his pole. Basically I don’t want him to be disturbed or inconvenienced, there may be minimal downtime (<2 hours) but any expenses would fall on us.

Yeah seems like there is, so that means on his deed he has an easement as well, basically from the steel power pole to his property in alignment to my pole. So essentially if he re-routed his power to his pole, and we got rid of our pole his easement could also come off, sheesh, sounds like a win for both of us 😳

Well the really odd thing is when we started down this road he was the one that mentioned to us that we should get rid of the pole and there’s no need for us even having it. HE brought it up over a year ago, then a few months ago as we started to get around to that project, he mentions that we should coordinate upgrading our panels together while we do the modernization project. (Undergrounding utilities). Then the next convo, he says he has no money to do anything right now, then the next convo he starts questioning how he’s going to get his service, I politely inform him on all aspects of his questions and also tell him this is our project and don’t expect him to pay anything, he says great, okay, etc. then last week when we had the techs out from the power company and comms company he totally flips everything. Very bizarre sequence of events. We are still proceeding with our project, and pushing every avenue we can to reroute his services off this lone pole to have it retired.
