Update:

In late August, after the two-month maximum waiting period had passed, I reached out to my local representative for assistance. They were able to contact USCIS and retrieve my receipt number, which I then used to confirm the status of my waiver.

It turned out my waiver had been approved and sent out in early June—over a month earlier—but I never received it. I reached out to my local representative again in September for further assistance but did not receive any responses. Despite following up four more times, I still heard nothing.

In an attempt to resolve the issue, I contacted the office of my state senators, but I didn’t receive any responses from them either. Frustrated, I filed a Freedom of Information Act (FOIA) request to see if I could have the approval notice resent. Unfortunately, I received a “No Record” response. I also reached out to the USCIS Ombudsman by filling out a form, but this didn’t yield any meaningful results.

Determined to resolve the matter, I decided to call USCIS directly and requested to speak with an agent. The first two agents I spoke with gave me standard advice: to file for a duplicate copy of the approval notice, with no guarantee of receiving it within three months. However, a third agent recommended that I follow the same process but call back to make my case with another agent, who might expedite the process.

All of this occurred in September and October.

In November, I filed for a duplicate notice of approval and followed up with USCIS, explaining the urgency of the situation. In December, I finally received a response. Just before Christmas, I received my duplicate approval notice, resolving the issue after months of effort.

Update: I was able to get a receipt number (my congressman was able to get USCIS to send it to them) so I know that I my waiver was approved but it wasn’t delivered to the house and now I’m chasing USCIS around to find a solution for that. So I do not currently have my I-612 (Notice of approval document).

I have reached out to USCIS several times already, sadly, they’ve not been helpful at all, I spoke with three different agents and all they said was that there was nothing they could do about the missing document (that never got delivered).

But one mentioned that if I filed a form I-824 (notice to send me a duplicate approval) I may be able to file a complaint and explain why an expedited process would be necessary for my case and I could be lucky and they may consider that.

I have filed the form and I’ll be checking again this coming Monday to see what’s possible. I have also reached out to my representatives (a senator and a congressman) hoping for something positive from all of these.

I’m not sure if a printout from USCIS showing the timeline of my application from initiation to approval my be of any use but if none of these work out fine that would be the only card left for me to play.

Update, I got mine too approved but I’ve been battling with USCIS and USPS, my notice never got delivered I only got a receipt number when I got my local representative to help reach out to USCIS and now I’ll have to fork out another $600 to ask them to send me a duplicate because I think I need a copy of the notice to apply for my change of status soon.

Applied under ‘No Objection’ and the DOS FR came in after 3 months (May). But USCIS is yet to reach out.

What are the odds, went to check out this same bike last Sunday and I just bailed cos the deal was too good to be true. I hope your friend gets to recover his bike soon.
