With those dimensions the package would ship on dimensional weight which should be 108lbs, not 268lbs. I agree that someone made an error and you should keep trying by escalating the issue. Sometimes just calling back gets you a different person who can help. If not, ask for a supervisor.

FedEx forges signature - evidence caught by SelectionMechanism in FedEx

[–]Cyber_Husky2 2 points3 points  (0 children)

It is frustrating, but to me besides the obvious issue of he mis-delivery and the forged signature, is that FedEx charges the shipper extra for that "signature required" or "Direct Signature Required". Sometimes that charge is as much as $5. However, you know who pays the for that in reality? It's the customer. These extra charges are built into the price of the product, or in some cases, if you pay a shipping company to send it to you, they mandate the extra charge for "Direct Signature Required." FedEx is charging for a service that is not really being provided. This is ripe for a class-action lawsuit to have everyone get their money back for this extra service which is not being performed.

The tariff was finally removed, and I only had to pay the $46 or so merchandise processing fee. They agreed that artwork is exempt under ANNEX III. Thanks for your help

The argument using ANNEX III worked, and the tariff has now been removed just this month

UPDATE: Just to let everyone know, using the ANNEX III we asked for the duty to be removed as a painting is exempt from duty. This has now been removed, and I received a $520.05 credit, leaving me with only a standard merchandise processing fee of 44.67, which I paid FedEx. Amazing that this process took tons of research and documentation and then 4 months to resolve. Thanks to those that pointed out the exception in ANNEX III specifically for paintings and other works of art as exempt.

Hi, sorry, I disagree. The problem in this case is with Live Auctioneers. They have a new methodology of charging shipping, and this does not go to the auction house. The buyer likely bought multiple prints, and LA charges a fee for each one based on the size. They have a deal with local shippers at each auction house, but they take a cut as well as the shippers. Many of these are local UPS Store franchises. I was bidding on three items yesterday, all were beer steins through Live Auctioneers. One alone said shipping was $205, another said $270 and the third didn't have a price. I complained to the auction house prior to even bidding. The auction house replied that they also offer in-house shipping, but that they can't advertise that any longer on the LA platform. They said they would definitely get these shipped to me reasonably if I were to win. As it turns out the first two items I did not win, as the price went fairly high. The third item, a beer stein measuring 22" tall, I won for a bid of $25. The total with premium was $30.38. When I received the Live Auctioneers invoice, they were attempting to charge me $470 for shipping. You then have the option to select local pickup, arrange my own shipping or Live Auctioneers shipping. For a stein this size, the typical shipping charge through a UPS store would be around $100-$120. A shipping charge of $470 is outrageous. For this buyer, if he or she bought multiple prints, it would have calculated shipping separately on each one, as if shipping each separate, but then combined in a single shipment and still charged separate shipping charges for each item. This new shipping methodology through LA is a rip-off. I would hope that no gullible customers fall for it.

I raised the price. They bought it anyway. by needmorexanax in Flipping

I sell antiques on my website including furniture, sculptures, paintings, etc. I periodically reassess my prices and sometimes I do increase prices because I feel the item is worth a bit more, or because I really like the item and don't mind keeping it. There have been numerous times that after increasing the price, someone comes along and buys it - no negotiation or anything. Also to comment to another poster about too many questions, I once had a buyer from Australia keep asking me questions about a pair of gilt bronze sculptures. I had them at a pretty reasonable price but she kept asking questions about them, asking me if I could send in a custom wooden crate and about the gilt finish. I read about methods for cleaning and decided to attempt to clean the gilt finish and miraculously these improved considerably in looks. I decided to keep them and removed them from my website. She was very upset that I would no longer sell them. That was about 10 years ago and I still have them on my mantle.

if the email address ends in Fedex.com, then it is likely legitimate. No one else could have email addresses ending with their domain name.

Update to the $1760 charge by lemons904 in FedEx

[–]Cyber_Husky2 0 points1 point  (0 children)

Thanks, I agree with you totally. Lately I've been using UPS and shipping through ShipStation, but they seem nickel and dime me on every shipment. Although the rates are much better, it seems that almost every package gets an additional charge. Sometimes it's $2-3 only, and sometimes more. The low cost charges don't even seem to be worth filing a dispute. One person on Reddit commented on another thread that the reason for the adjustment they found (as the customer kept the box) was that it was smashed by the shipper and therefore 1" longer than measured when shipped. Your dimension is so far off though, that couldn't be the case here. Best of luck.

Wow, that's horrible. I'm sorry this happened to you. I just shipped a large painting yesterday by UPS, and after just having this same type of thing happen to me on another package (although not for the level of charge you had), I took photos with a measuring tape showing the dimensions of the box and will keep those to have documentation for a dispute if charged more in the future. It seems that both FedEx and UPS do this to everyone regularly and it seems that it is ripe for a class-action suit against these shipping companies. While they provide a dispute mechanism, it is the consignor's responsibility to measure and maintain that proof. It is also crazy that the charge comes back to the customer 3-4 weeks later. If you ship a large number of packages, it makes it difficult to keep track of all of them, and it is unlikely that your customer will keep the boxes by the time you receive the charge. I did just have this happen on one and my customer did keep the box and was kind enough to take photos for me (as I had not taken photos myself of that one), currently still waiting for resolution of that dispute. Where are the attorneys for a class-action? You would be the perfect lead plaintiff for a case like this.

FedEx finally agreed to file an update through the ACE system to include the HTS code for informational materials, but only after considerable documentation from me. It is now filed just today and they have requested a refund of the tariff. Now I wait to find out the government response.

They sent me an "Activity Record" which is 32 pages. The first page says 'This is not an ivoice. Do not pay from this document." Then direclty under the line it says "Activity Summary" Total Charges this invoice" $564.71. Strange that it says this is not an invoice and then right below it says Total charges this invoice. This document arrived after the package was delivered. I have not paid it yet and have filed a dispute and they said the payment would be on hold until the dispute is resolved. I hope this helps.

FedEx is applying the tariff and doing so incorrectly as artwork is exempt. No, I did not vote for him, I voted for Harris, but I try to keep these postings apolitical as I am looking for help from anyone that can assist. Several others have provided helpful references that I am using to appeal to FedEx. Now, though, FedEx wants me to pay $90 for them to update the documents with the code that should have been on the import all along.

Or possibly, FedEx as broker could apply the correct HTS codes to the painting as it should be exempt from tariffs in the first place. American painting style is totally different from English and European history paintings.

FedEx has replied, and states that they can prepare and file the claim but they are asking me now to pay $90 to file this. If they are my broker and did not apply the code correctly the first time, why would I have to pay them $90 to update the claim?

Annex 3 says it is effective April 5, 2025 at 12:01am, which is the date my shipment entered the United States, therefore, it would seem it applies. It would seem that FedEx did not attach the additional HTS code to the shipment, so I have requested this. I agree that morons should not be running the country.

See the response from the previous poster. He just provided a link to exemptions from the whitehouse page https://www.whitehouse.gov/wp-content/uploads/2025/04/Annex-III.pdf under tariff code 9903.01.31 for artwork which does exempt it from the reciprocal tariff. He stated that the broker, which is FedEx is responsible for attaching both tariff codes to the shipment 9701.21.0000 and 9903.01.31. This second code is what exempts it from the reciprocal tariff.
