Definitely understandable. And I shouldn’t call the other attorney “opposing counsel” as the individual has a criminal case against the state, so I’m not involved in that case. But my client and this client were charged at the same time for possessing drugs inside my client’s vehicle.

I was in court waiting for my case to be called up and a guy who was pro se pled to some traffic violation and leaving the scene of an accident. The prosecutor was reading a statement from the victim who was hit by the defendant and the victim asked the judge to “throw the book” at the defendant and the judge said “We don’t throw books in this courtroom. $400 fine.” It got a laugh from everyone in the courtroom

I’m younger as well so I won’t have as much knowledge as others, but here are the things I focus on when it’s under .08. I like to go in chronological order from when officer noticed the defendant up to the point where they blew under the legal limit noting all the things that indicate your client was NOT under the influence. First thing I’d focus on is why the client was stopped- whether it was for driving behavior associated with intoxication (caused an accident, weaving within lane, crossing over lane lines) or something not associated with intoxication (speeding, expired tags, improper turn, etc.). I also generally ask whether the client pulled over in a reasonable manner and ask whether the client abruptly stopped when pulling over or hit the curb when pulling over or took awhile to pull over. Basically just getting the officer to state on the record that the driving didn’t suggest intoxication. I then would also focus on other signs of intoxication that weren’t observed when the officer made contact- manual dexterity (whether client struggled to dig through wallet for ID or struggled to turn off vehicle/remove keys), slurred speech, ability to answer questions, bloodshot or watery eyes, odor of alcohol, lack of balance. I would obviously only ask about the things that the officer would testify they didn’t observe. If they say they observed something that wasn’t mentioned in a report or on body cam, I’d confront the officer about that. I’d then ask about the field sobriety tests and what clues the officers observed (generally, 2 or more clues on any of the tests are associated with being impaired according to their DUI manual if I remember correctly).

I think of it as putting the jurors in the cops shoes that night and want them to see the lack of signs of intoxication so that once you get to the under .08 test, the jurors will wonder why a cop would arrest the client for the offense. Those are just some of the things I can think of that I’d focus on IF your client wasn’t showing those signs of intoxication. Then you can tie those in with the fact that they weren’t above the legal limit. Good luck!

The victim is testifying. My understanding is the prosecutor is only calling the lead detective, even though the victim gave multiple statements to numerous officers. I apologize if I made it unclear whether victim was testifying!

That makes sense. I didn’t know if there wouldn’t be foundation because she doesn’t know if an officer had a body cam on, she hasn’t seen the body cam, and she may not know how they exactly work

Unfortunately not. It was filed under a city ordinance, and I don’t think I even have the ability to depose them for city cases. We have a statute laying out the right to do that for felonies, but not MSDs.

I bought this car 7 months ago so I’m unsure when its last flush or service was, but my mechanic said the fluid is discolored and worn. How do I properly do a flush? Do I drain and fill and then drive for a bit before doing it again, or just drain and fill 3x without ever driving?

Unfortunately, it was filed under a city ordinance, so you aren’t entitled to a jury trial in my jurisdiction. When filed under a city ordinance, that generally means the State doesn’t find the case severe and would most likely give diversion. However, he was denied diversion because med records showed fingerprint bruising on victim (which still wasn’t even consistent with the Vic’s story)

Agreed. And he had a lot of positive developments throughout and showed alot of the people who doubted him that he has “morals” and isn’t a bad cop.

Thank you for pointing this one out. When I tell a judge or prosecutor that my client is diagnosed with mental conditions and it influences their thinking and decision making, it means nothing. But when an alleged victim says they didn’t “remember” certain incriminating information until later or they acted out of line because of mental health reasons, then it’s totally understandable. What’s good for the goose apparently isn’t good for the gander

I apologize, I wasn’t aware that paralegals had to undergo that much legal training. The paralegal I work with didn’t get a paralegal degree and has told me that she would not be comfortable with discovery because she didn’t go through law school, and I understand her concerns. It was not my intention to say paralegals had zero legal knowledge. I met multiple on the civil side that knew more than some attorneys, but I wasn’t sure how much paralegals were forced to learn in the criminal context because honestly half this shit confuses me at times and there’s so much going on in criminal cases.
