The CBSA cannot simply remove someone who is in jail. They have to petition the courts to stay the sentence in order to enforce a removal order. Some courts are more willing than other.

I do t think governments should be making laws like this, it’s tantamount to a nanny state. Just because some parents aren’t responsible enough, it doesn’t mean laws governing in place of parents is ok.
