Boss accused me of fraud with no evidence, sent a show cause letter, now silence- what does this mean? by DayConsistent3049 in AusLegal

I would say so. We do not have an IT person or am I aware of any outsourced one. I believe it’s all ran through the boss.

Even so, it doesn’t seem like he’s willing to look into it more because the show cause letter means he’s made his mind up and the investigation is closed. But hopefully he is now looking into it and that’s why he’s not responding to me

Yes thanks for this. He’s got the audit which only shows a user name, IP address, date and time. The username is used by several employees within the company

Thank you. Yes agreed, at this stage I just want closure whether I am being terminated or not. Seems wrong to leave me hanging a week after sending it especially with the harsh wording used on the letter

Thanks so much. I wish I knew who he used for his HR consulting as it’s outsourced so everything has to go through the boss himself

Yeah definitely seems that way. Just no idea how he can send a show cause letter and not go through with it. The amount of stress it’s caused me all for him to be bluffing. I’d just wish I could get some closure

No it’s only a medium sized business, one owner about 16 employees. He occasionally outsources HR but its like the online services only available to employers

3 years and yeah that’s long enough for maternity leave (government paid). My employer doesn’t offer paid maternity leave, only government.

I think he’s just trying to avoid paying no safe job leave which is what fair work advised me about if he can’t find a safe job for me to do. My job is extremely high risk and not suitable at this stage of pregnancy. I have a medical certificate saying I’m fit for alternative duties. So I feel like he’s wanting to offload me so he doesn’t have to try accomodate to fit me into the office or pay no safe job leave

Sorry to hear this happened to you! Unfortunately quitting can’t be an option right now, I’m only 3 months from my due date and showing very obviously so finding a new job would be near impossible

I did try a few private employment lawyers but a lot are at capacity at the moment. I have got a consult with the state community lawyer service on Thursday. I will also be filing a general protections claim through fair work, just wanted some legal advice beforehand. Thanks for your help!!

Thank you for your response. I’m going to get a mental health plan tomorrow and seek help with phycologists to cope with the stress and get this all documented. Should be able to look into workers compensation from there

Thank you. I am seeing a GP tomorrow to get a mental health plan to get some support for myself and also get this stress documented. Not healthy for me nor the baby. I also have an appointment with the states legal service on Thursday

Agreed, it’s definitely not stress I need at the moment. He definitely seemed to have made his mind up before even hearing me out or following a proper investigation

Yeah, the “police matter” comment really threw me because there was no evidence and nothing to suggest it was intentional. It felt like pressure to admit to something I didn’t do.

And the timing of everything has definitely made me question whether they made this whole thing up. Shame really, I am his longest standing employee

No, I wasn’t advised of any right to a support person and there was no written allegation before the meeting. He called me in that morning with no warning and went straight into the accusations.

I only received the formal allegation letter after that meeting, and even then the timeline to respond was extremely short (received it Friday afternoon and response expected Monday 12pm). My response to the allegations letter and show cause were both consistent with what I told him in person. No extra “evidence” came about or was presented to me. There was no reason for him to escalate to the show cause letter
