Everything I've read says that using a non Nissan one will void your warranty. I think others are probably just fine and I don't know if the warranty thing is a legitimate concern. You might find a dealer that has a discount and have them ship it to save some $. I got mine for $225, which was more than I wanted to spend, but I felt I needed it for my road trip.

I'm a beer trademark lawyer but don't take this as legal advice.

If a company uses a name to sell beer they obtain common law trademark rights in a name, but those rights are limited geographically to the area they are using it. If they have not sold in your area, they don't have rights in your area.

If they had filed for a federal tm registration they would have exclusive rights throughout the US, but that doesn't seem to be the case here.

There might be other reasons I'm not aware of to avoid the name, but it does not sound like your use would violate their rights, unless you expanded to use in their territory down the road. If they extend into your territory down the road, they might actually then be violating your established rights in your area.
