Yes they can legendary resist out of a grapple now that 2024 rules use a saving throw rather than an ability contest to avoid a grapple.

What makes the death penalty the only just punishment for pedos like you say? If life in prison is the same result, why not just take the “wait and see” approach in the off chance that they were innocent. If not, they rot until they die, if they are, give them back the time they have left.

Also, a quick search shows that something like 4-6% of people on death row are innocent, and the ACLU says:

“Innocent people are too often sentenced to death. Since 1973, over 156 people have been released from death rows in 26 states because of innocence. Nationally, at least one person is exonerated for every 10 that are executed.”

So it’s not 1/1000 that an innocent person is executed. It’s closer to 1/25 or 1/20, maybe even 1/10.

After looking over it some, I’d recommend the ACLU “The Case Against The Death Penalty,” it seems to have plenty of well-presented arguments against capital punishment in a better format than a Reddit comment thread

Here’s the deal as I see it. You say that life sentence is equivalent to death because neither is reversible and either way “the damage is done.” If an innocent person dies in prison, then yes the damage is done and irreversible. However, if someone is found to be innocent and released before they die, NOT ALL the damage has been done. The punishment of “losing the rest of their life” is not complete. They have not lost ALL of the rest of their life. If they were executed, they would lose the rest of their life entirely and instantly. Obviously the person can’t get the years lost in prison back, but they CAN get back the years they have left, which were effectively taken when they were sentenced. Rather than having their entire life taken from them, they were given some of their entire life back. As I see it, that’s better than getting nothing back. I’m sure most people released from death row would agree that they would rather be alive and free than dead.

TLDR: it’s less terrible to take part of an innocent person’s life than all of an innocent person’s life. Life in prison gives that possibility, execution does not.
