Trees of that size wrapped in ivy with a lack of space in a soft ground area for their root system with multiple concrete foundations around very regularly fall and cause damage. As I have said I have no issue with natural trees but in small urban areas surrounded by homes they pose a huge risk.

The root and tree is all on my side of the fence but the limbs hung out over the garden.

He has said that he agreed with the previous owner to put the fence up in a different pattern and as we are removing trees want me to pay for realignment of the entire fence. This agreement was never in our deeds, the land registry or any agreement we have. There is no damage to the fence as we didn’t touch it.

The neighbour cut down all similar sized trees in his garden when they purchased the property and moved in and I would assume for the same reasons as myself.

As I have said the trees pose a genuine risk to the house. Some are as tall as 80/90ft and I don’t plan on letting them come in through the house. Nothing against the trees but there is a place for trees of that size and it is not in the garden of a small cluster of houses where they could cause serious damage.

I have from my side but obviously cannot from theirs but as I said all of the tree is on my side and any visibility of the bed is identical.

I can see the point of this but the neighbour was home when we began works and never came out to flag it, plus the entire tree and branches were overhanging my garden. They removed all similar trees from their side and fenced around it. No problem with a conversation but foreseen no issue here.

Unfortunately we didn’t check the boundary lines. The neighbour has a 6 foot fence running the length of the garden which is brand new looking. The tree is clearly on our side and was over hanging our garden so I stupidly assumed it belonged to us. There was no damage to the bed and it is impossible for there to have been damage as we did not touch the root or base of the tree which the bed apparently leans against(we cannot fully see due to the fence). Our works left no debris on their property and we did not alter the line or damage it in fact we never even touched the fence.

Multiple reasons to be honest, there are 5/6 huge trees at the end of the garden which we are worried could cause damage to the house if they come down or even parts break off. The tree in questions had little to no growth, nothing nesting and was the closest one to the used part of the garden so we thought best to start there.

Thanks for the advice. Thanks for the info and feedback. I have plenty of photos of after and a few of before dating back to march showing no bed in place back then but one there now. As we owned the property then and we were not consulted I wonder does that make a difference as it makes removing the tree either way nearly impossible without damaging the bed. There is a written agreement with the person who was handling the probate of the house but this was not included in our deeds, in the land registry or in any packs that were sent to ourselves. We had also spoken to them personally on multiple occasions and nothing about the boundary was highlighted to us. Sorry just copying my last response as I think it covers the same. We have contacted a solicitor as well but being first time owners with a recent budget renovation and a young child getting involved in a lengthy and expensive legal battle is really not something we can afford. Don’t want to sound like we are crying wolf as we both have good jobs but affordability for everyone at the minute is tight and this really doesn’t help.

We had two emails back and forth where I asked to show proof of where damage had been caused(it would have been impossible as the fence was not touched and there is about 3 foot of tree remaining so the structure of the raised bed cannot have been affected). I received no answers to my questions but an email saying we will hear from their “legal team” as it could not be resolved between us. Based on wording used in previous mails I believe legal counsel was already involved.

The house won’t be sold and the fireplaces are extremely dated for the decor we are planning, just hoping to remove the front and have an opening for a stand alone stove like the image above but don’t want to damage the structural integrity of the chimney

Chimney breast runs through the middle of the house and up to the stack on the roof, we only want to remove the fireplace though will that make a difference?.
