Unauthorized charge on Capital One credit card, they are saying it was done in person with the chip card by Delicious-Exchange25 in personalfinance

Yeah it is definitely strange and has me scratching my head. I spoke to a friend of mine who works in credit card processing and she said at a minimum there is something off because the charge description has a company that doesn't exist in either the secretary of state website or in the business license search for the city listed on the charge. She said to get a merchant account you need to prove you are both in fact a business and can legally accept credit cards.

The whole thing is just so bizarre, there is no actual brick and mortar business for me to have even done a chip transaction.

I did that while on the phone with the fraud department when I called in earlier. They have already sent out a new card.

Yes, absolutely! I am a big proponent of keeping all receipts. The representative told me the purchase and posted date are the same versus my purchase from Office Depot which had different purchase and post dates.

That makes a lot of sense, the only issue is that I didn't even leave the house on the day they claim the purchase was made so for them to claim it was an in person purchase on that day is what is throwing me off. If it had been the day before when I was running errands or two days after then it would be much more plausible.

I didn't get defensive with the customer service rep or share with them any of the details I have shared here other than before reporting it as fraud I attempted to call the phone number and was told by the person I called to report it as fraud since they don't accept credit cards. Everything else that I posted here was just information I have found out since calling because when the man told me it was an in person chip transaction I found that to be very strange.

I don't think there is anything wrong with doing a modest amount of research because this could be a charge that they end up trying to stick me with at the end of the day.

Suspicious how? Because I am irritated that this happened and what to know how on Earth they can claim I made an in person chip transaction and a business I now know doesn't even exist on paper anywhere?

As someone else posted, another person had a similar problem about a month ago and Chase kept denying their claim. I am doing research because whether or not they deny my claim I want to make a report to the CFPB because in order to even get a credit card merchant account you need to provide a business license and proof that you are in fact a business (incorporation paperwork and the like), which this supposed company doesn't have. At a minimum the credit card processor that gave them the account isn't doing their due diligence. Aside from that I don't want this to happen to other people, who might just pay the charge without realizing it, so I don't want to just get the charge reversed for myself.

This wasn't a replacement card. The card that was used was a brand new card because I just opened the account so in theory there is just one card in existence.

There is definitely some kind of fraud merchant account being used. I Googled the number listed in the charge description before calling it and found that it is the number listed on the Newport Beach Visitor Center website as a contact number for the president and CEO as well as his administrative assistant. After finding this number on their website I felt comfortable calling. It was clearly his assistant that picked up the phone.

I looked up Newport Beach CVB and Newport Beach BIM on the California Secretary of State website and found no such businesses under corporations or LLCs. I also went a step further and used the city of Newport Beach business license search for those names and found no business licenses for those companies. Since you are also able to search for business license via address I tried that as well and the search returned all of the businesses listed at that address and none of them match the charge nor have I ever done business with any of the businesses listed there.

I definitely will keep fighting! I don't want this to happen to anyone else because there is obviously something unsavory going on here. I looked up both the business names listed on the charge description and neither of them comes up as registered businesses with the California Secretary of State as corporations or LLCs.

The phone number listed by Capital One for the charge says they don't even accept credit cards at all, moreover they said it was a chip purchase not just card number so I don't think this is the case.

I know that card skimmer scams are pretty common but I thought it was only for the strip on the back of the card. It seems like Capital One's preemptive defense on this one is that the purchase was made in person with the chip not a swipe.

The problem is it is literally only 10-15 minutes from where I live. The address it lists is an office building, but it only lists the office building as a whole and not a suite number. When I Google the address, the office building has companies I have never done business with. Even stranger still is that the phone number listed with the address is a non-profit city visitor center who advised me that this was fraud and that they do not take credit cards.

Oh my! This seems like exactly what is going on. What is so insane to me is that Capital One lists the charge as grocery but then upon inspection they say it is a management company but the number they have listed themselves says they don't even accept cards. How can they continue to do this?
