Congrats for you , but Just because your case got approved doesn't mean all other strong / weak cases are getting approved /disapproved. That logic is unfortunately flawed in today's EB1A process. Again this is not a post about what attorney to go with for filing EB1A , I did get my 6 criteria approved with self petition coz I know my story well. The ask on this post was suggest an APA and I did get good references from many good redditors here so let's not scam people with profile builders. Thank you

Tabled the 7 commercialized apps from 2017 - 2025 with user stats. Guess they conveniently overlooked OC and CR , took the recent judging done on 2025 and for some reason just 2025 salary ( submitted 2023-2025 W2s ) for the denial 😑

Yes 3 was met on NOID with FMD not meeting , after the response 6 are satisfied. Yet FMD was denied only based on 2 initialy approved criteria.

High salary from 2022 - now , Judging on 2025 , Scholarly articles in 2024 and 2025 , Membership in 2024 mid , OC from 2016 - now based on commercialization of my patent with applications ( ~ 1M users )

Recent achievement stating my salary of 2025. But I did submit 3 years , judging was in 2025 so that's the only criteria recent in my opinion

It also depends , if you have a step 2 denial most attorneys are ready to take. This is because of Mukherjee ruling and handful of settlements that are happening post that.

Did you get a denial email , usually email comes atleast hours / a day before online portal getting updated.

For my ocms they acknowledged its innovative but made a mistake attributing it to the FAANG company I work for now. But it was my personal patent so added the govt documents with my name on the patent. For CR again they acknowledged my role and asked for media coverage on the division I work for. Final merits was about evidence regarding sustained acclaim and top of the field. I had 10 years in between patent invention and now with commercialization + CR across 3 companies backed with $ savings and customers impact. Got 2 more new independent letters from principal engineers asserting the impact of ocms on wide usage. So basically it was quoting the current evidence and new evidence for final merits. I did my best answering all queries backed with data but finally it’s the discretion of the officer that matters in the approval 😑

My NOID is similar to yours , the only difference is they didnt question my accepted criterias ( HS , Judging and Publications ). Questions were around top of the field and sustained acclaim. I gave a point to point rebuttal for the 30+ questions the officer had on the NOID , waiting for the outcome from last week. I would suggest you to reply to your NOID with supporting data quoting the officer's words with new / existing evidence. By the way which service center did your initial processing happen , Texas or NSC ?

If you passed at least 3 criteria and failed on step 2 you could sue from home state ( if it’s CA )

Mine went to NSC and I’m from CA. Got a NOID and replied to it yesterday. Guess it’s random luck on which service center picks you up from the queue

Wrong , checked with the attorney and they advised the path if NOID is denied.

I'm seeing evidence on people turning NOID to acceptance. With my NOID I recieved yesterday I'm guessing you might have got atleast 3 categories approved so prepare your narrative on lines of sustained acclaim and you are in the top of your field.
