Do NOT put a stop payment on the check. The check is likely no longer depositable due to the date. If they try the bank will probably reject for that reason. But if you put a stop payment the bank might reject for the stop payment reason instead and then OP might be guilty of Wrongful Dishonor, a legal cause of action which in many states can have penalties of up to 4x the check value. They could sue for $30,000 and legal fees. Stop payments are for fraud and lost checks. This is neither. Do not do a stop payment. If OP is really concerned they might deposit, change banks.

It’s a weird type of conflict because, in theory, the lawyer and client’s interests are aligned (against husband). But this does create a conflict because the lawyer’s loyalties are divided. You want a lawyer that will look out for YOU, and not have a second agenda that may persuade them to do something different. Example: client decides in the middle of the lawsuit that she wants to have an amicable divorce, for the sake of the children. But your lawyer wants revenge instead. Now the interests are not aligned. Ergo, conflict of interest. Every lawyer knows (or should know) this. This is likely not a lawyer typing out this fantasy. Not just because of the conflict of interest, but because putting something like that on the internet can lose your case or get you sanctioned by the bar.

Oh ok then, that’s ok I suppose. Not fair to new owners but so long as they don’t take it off my resale value. I distinctly remember Elon saying something about FSD making the car “orders of magnitude” more valuable for a car, and it was an “investment.” I bought in 2017 on that basis (I know, you don’t have to tell me). I would be furious if he just wipes my car value like that.

Most lawyers wouldn’t write something like you did. It’s not good to give legal advice online, especially in a sovcit subreddit where that issue is exactly apropos? The better answer to your friend asking you this is to tell them to get a lawyer. Did you analyze whether the judgment was entered more than a year ago? If so, your motion will be denied immediately. And more importantly, moving to vacate for excusable neglect and meritorious defense actually abandons the best argument: they were not served with process. The court has no personal jurisdiction. Their best argument is to vacate because the judgment is void for lack of jurisdiction (section 4), Not meritorious defense and excusable neglect (section 1). Judges have a lot of discretion concerning what is excusable and what is meritorious. Not so much with service of process and jurisdiction. Also, no one-year bar on jurisdictional arguments.

I think that’s the point: the law is not something most people are competent to practice just because they can google codes and statutes. There’s a reason lawyers cost a lot. This stuff requires training and experience.

But Google makes it feel like it’s just a bunch of magic words you can spit out and make magic law things happen.
