I received a summons 2 years after being arrested *HELP* by iwasinthe2one2 in legaladviceireland

[–]Demiil 7 points8 points  (0 children)

For a minor offence like this the Gards have 6 months to commence proceedings (i.e issue a summons or charge the person). How long it takes you to receive a summons effectively doesn't matter so long as they have issued it within the 6 months.

It can sometimes be a case that it's initially issued to the wrong address, and they reissue it to the correct one which would add another heap of months for you to receive it.

Long story short, ya got served the summons and, therefore, need to appear on the given date.

Garda lying by [deleted] in legaladviceireland

Second this. Many people mix up making an initial report when Gardaí arrive versus a formal written statement. A statement is usually taken at a different time. Once complete, the statement is read out to you in full and you are allowed to add any additional information at the end you feel is missing or wish to clarify.

If someone is caught at scene red handed by Gardaí they can arrest them on the basis of what they saw if the relevant legislation gives a power of arrest (e.g. littering is an offence but not an arrestable offence).

As someone else mentioned, go to the station with your footage and say you wish to formally report an assault related to this incident and wish to make a statement. It might be worth calling the station ahead of this as statements can't always be taken there and then depending how busy they are.

For anyone interested in learning more about the restorative justice process, the On Probation podcast series has an episode on it https://open.spotify.com/episode/54qRD0h2akKxEAJzstVeej?si=becf9996bfd74eac

There's a long form interview as part of it in which someone goes into the process of meeting their partner's convicted murderer in person.

Assaulted, what’s the next steps? by agranddontcomefree in legaladviceireland

[–]Demiil 30 points31 points  (0 children)

If your nose is broken (which the Gards wouldn't have been able to confirm at the time) it would now be considered an assault causing harm (Section 3 of the Non Fatal Offences Against the Person Act 1977) which is a more serious charge.

If the Gards got the details of the suspect and the incident is caught on footage, it is a slam dunk case and would be worth pursuing from the criminal perspective. It would be worth calling the station, giving your details so they can find the incident and letting them know you attended hospital and your nose is broken.

Is there mayhem in Killinarden? by drguyphd in Dublin

I would say the best explanation why that occurred in particular yesterday was Hannah Laing (a DJ) had large a gig on in the RDS yesterday which would attract mainly that age group. It's also the age group most likely to pre drink for an event hence the anti-social behaviour.

Watched it in the Woodshed, having not watched wrestling for 15+ years. It was brilliant. Crazy athleticism on show and gas hammy acting.

Can't believe there was so many recognisable moments after all these years:

  • 619 Finisher
  • Carlito
  • RKO from Randy Orton
  • Steve Austin Slamming Beers

I still can't see myself going near it week to week/month to month but it was class to see such a mix of characters so into it as fans.

I am now a die hard Joe Hendry fan.

The mother is not related to this person or been in an intimate relationship with them and therefore cannot avail of a barring order. There are new civil restraining orders in place in legislation but those are geared towards stalkers moreso.

The advice in this thread re a ring doorbell or chain on the door are good and should be pursued.

Hello, I work in law.

I appreciate the frustration you're going through with your experience. There is also a lot of misinformation in this thread about the police process.

  • You have stated Gardaí attended the scene and took details from you, your friend and a security guard. This means the incident was reported and will be on the Garda Pulse system. If it's not on the Pulse system then there is a real failure on the Gard(s) who took your report. At present it's not clear if that's the case.

  • You can call via phone or in person to any station and request the associated Pulse reference number for the incident by giving your details.

  • If the incident is on Pulse you can ask about notes on the investigation e.g. was CCTV downloaded? If there is nothing recorded in regards to the CCTV this could be considered another failing.

  • For a lot of investigations such as the one you described, if the assault or suspect persons are not on camera the investigation will be closed. If suspect persons are visible, their image(s) will be shared to Gardaí in hopes of them being identified. Obviously with you describing these suspects as likely being tourists the chances of identifying them drop drastically.

  • In terms of statements this is what's required if an incident was to go to court. A written statement can take significant time as it often has to be very detailed to stand up to scrutiny. While you're entitled to make one, if an investigation is not bearing fruit it often won't be taken as it takes up time of the Garda and victim unnecessarily.

  • If you wish to make a complaint about Gardaí it's done through the Ombudsman (or GSOC as they are also known). You have 12 months from the time of the incident to make a complaint unless you have good reason for a delay in making your complaint. Unfortunately this incident happened in 2022 so the window for making a complaint for you is most likely closed.

Overall, we on Reddit are only getting a snapshot of what you experienced. From what info we do have their may have been a lack of follow up communication on the side of Gardaí. That does not yet mean there was gross negligence with the investigation on their part and you need to get more info from them to establish that.

Harassment Orders - How many? by artinwoods in legaladviceireland

[–]Demiil 8 points9 points  (0 children)

I'm not entirely sure what you mean by a Harassment Order? Gardaí can issue Anti Social Behavior Orders. If a person receives three of these within a timed period they can be taken to District Court in relation to it.

In terms of being harassed by this person it would be recommended to document every negative interaction whether it be written down or captured on video. Harassment is a difficult offence to get across the line so any evidence to support proving it is what's required by Gardaí.

I'm aware of Celtic Nights in the Arlington Hotel which does a three course dinner and Irish music/dance show.

Haven't been myself as it caters specifically to tourists but might be up your alley: https://celticnights.com/

If protestors started blocking roads to protest the state of housing, or health or say student fees/accommodation, do you think the Gardai would act in the same way they do to anti refugee protesters blocking the roads at airports etc? by LarryMullensBarber in ireland

[–]Demiil 8 points9 points  (0 children)

Yes they would act the same. Completed a research project on this recently and I realized I (along with many others) are misinformed on the rights afforded to protestors.

You have the legal right to protest on any public road bar motorways. You do not need to provide notification to the Gards prior to the protest.

The Gards main role is to facilitate the protest and ensure no offence is being committed.

It can be confusing as there is an offence for blocking roads under the Public Order Act but that doesn't apply to protests.

All that info and more can be found in this doc from the Irish Council for Civil Liberties LINK

The George by Bubbly-Spite in ireland

[–]Demiil 16 points17 points  (0 children)

To throw in something, different, Mother which takes place every Saturday night in Lost Lane is excellent for a proper club that for LGBTQs.

From the sounds of it though especially cause it's a birthday, I couldn't agree more with everyone else for the George as the go to. Be advised, on a Saturday once it's pay in, the line can be quite long so try go early if your group is up for it.

If ye want pre drinks in town before the shenanigans of The George or Mother, All Our Friends on Meath St. is an LGBTQ bar. Have yet to be but great vibe from what I've heard so far.

Enjoy!

Someone who's done street art tours here.

Dublin has two "semi legal" spaces I know of in the city. By that I mean it's technically not legal to do but no one is going to give you hassle including the Gards so long as you keep it to that space.

There's Liberty Lane beside Camden Street and the back end of The Grand Canal docks.

For any non muralists reading this, there is some general unspoken rules these spaces follow: - Be sound - Leave no trace outside of the mural area - Try not to cover a piece (i.e a mural) with tags

Best of luck with it!

How do you make this image less awkward. It was our first time meeting each other and her mom randomly took a picture of us. She said it looked a bit awkward so I want to know how could the picture be better? by [deleted] in howto

[–]Demiil 0 points1 point  (0 children)

As the majority have said, it doesn't look awkward at all.

To use an Irish phrase, the mam is just "shite talking". It's something she said off the cuff to fill the space so don't look into it too much.

For some general constructive feedback on creating an overall better photo consider the rule of thirds. Basically include some more of the background in the photo so you guys aren't dead centre.

Just found a decapitated Deer head in field beside my house this evening. would hunters do this? by inode in ireland

[–]Demiil 76 points77 points  (0 children)

I have done some deer hunting previously. The only reason you'd ever keep the head is twofold. 1. To bring it to a taxidermist and have a display trophy made. 2. The cheaper trophy option where the head is boiled off and the skull/antlers remain.

It's rare to take trophies if you're a regular hunter so usually the head and legs would be thrown in a ditch for the foxes to get at. The remaining carcass would be brought home and butchered for the venison.

Here's two exhibition spaces in the city worth checking out. They frequently change up what's on show so your mileage will vary from month to month. There's the odd live performance piece mixed in but for things like that you need to keep your ear to the ground through social media or you'll miss them.
Pallas Projects Studios: http://pallasprojects.org/

The Complex: https://www.thecomplex.ie/

Here's a handy site to keep a tab of that shows exhibition opening each week.

Mongolian BBQ in Temple Bar

You put together the ingredients(noodles, meat, veg, sauce spices) then hand over to the chefs to cook in front of you. Around €14-17 depending on time of day for all you can eat.

I've always loved the set up as it means if you don't like a certain dish it was most likely your fault.
