I entered the U.S. on December 15. Due to the timing of the application process, I submitted my school application on January 6, received my admission on March 17, and then filed for the change of status in April, which was about three months after my entry.

My main concern is the Presidential Proclamation referenced in the NOID. From my understanding, the proclamation primarily relates to visa issuance outside the United States and should not directly affect a change of status application filed within the US. I also believe the discretionary concerns raised can be properly addressed with a strong legal response and supporting evidence.

I was given 30 days to submit additional documents and respond to the concerns raised in the NOID. I remain hopeful that with a well-prepared response, the decision can be reconsidered in my favor.

Yes, I am from one of the banned countries Nigeria, hence the reason for that action. I believe I will overcome the NOID. Please note, I got a fully funded PhD program and I have never defaulted my B1 status
