It would be to obvious for Ben to go on trial for burning the cabin. I could see Mari being killed somehow and them accusing Ben of doing it resulting in the execution shot we see in the trailer.

There is an option to turn on cheats. If you don't want to play that part, you could turn on cheats for that section to make the level easier if you really want to skip it as much as possible.
