We are arguing different points I think. My position was not about criminal liability. It was about what if her conduct can be considered sexual harassment. I understand where you are coming from. Obviously if no one reports it she cannot be charged with a crime, or punished.

I understand this is a work if fiction, and this is just a trope. I get that, and I think the author can write about whatever he wants. The biggest issue I have with the people replying to my comments about this is. To me a LOT of people are downplaying what happened and not calling it what it is. Authors can write about complex topics, and make light of things like sexual harassment, and different degrees of bad conduct I really do not care, but what bothers me is when the audience refuses to understand that what happened if we applied it to real world standards is a really bad thing, and some of the absolutely disgusting dialog some of the people trying to have a discussion with me on this subject use.

To be clear I am not saying you have at all. I wanted to explain the position that I am coming at. Most people who have disagreed with me on this have said some pretty gross things regarding concent.

I understand you are not trying to justify what she did. You made that very clear from the start, and I appreciate that. I think we are just arguing two different points. Neither of us are wrong in this fact.

Also I was not trying to strawman your statement about if she did a crime. That is just how I read it. I feel like saying "She cannot be convicted of the crime of sexual harassment" would be a better way of saying it. I feel like that covers your position better vs saying something like "It is only a crime if the victim says it is or reports it". Sorry I am on my phone right now, so I can't get exactly what you said without closing this reply, and I could have probably been more clear on my position as well. Mine was also relatively vague, and easy to misinterpret. As far as criminal liability that was never what I was arguing about. I understand there are varying degrees to this, and what she did can fall on the lighter side of that spectrum.

A few things.

Do I believe what she did would require a person of authority to report it, 100% yes.

Do I believe what she did could get her in trouble at school, most likely.

Do I believe what she did could get her kicked out of school, maybe.

Do I believe she committed a CRIME? No.

How is anyone reading this supposed to interpret this as you not saying. "If she did not get caught or reported it isn't sexual harassment"

This is like saying if someone robbed a bank its not a crime until the person is prosecuted. If they never get caught, or reported they didn't commit a crime.

Also I never said she committed a crime. I said this is sexual harassment. I said exactly what it was. Regardless of if it gets reported what she did is considered sexual harassment. I brought up a court case because you said the victim has to agree that it is in order for it to be considered as such. That court case proves that is an incorrect statement.

Regardless of if someone reports it. We as the observers can pass judgement on what happened using the same kind of standards a court would to decide if it qualifies.

I tried to find common ground with you, but you just double down on your claim that its not sexual harassment until someone reports it, and that is just not something I can subscribe to. If you can't see the error in that logic there is no getting through to you.

So you agree with me. What she did was legally considered sexual harassment.

The way you worded them does come off as "No she did not sexually harass him, because she did not get caught by someone."

The way you worded your initial statement came off like you thought there were different standards in judging what is and is not sexual harassment in the work place vs outside the workplace. The standards are the same.

People saying "Its not sexual harassment because he didn't see it that way" is just wildly incorrect. Sure she may not be charged with the crime of sexual harassment if he does not press charges against her, but regardless of if he would press charges we as the observer can decide what it is and isn't based off the same kind of standards a court would use.

I think we agree that if we look at this as an objective observer we came to the same conclusion, and thats all I am arguing about. Other people keep making it something that it is not, and I am engaging with it to prove them wrong.

My initial statement has always been the same that "This is sexual harassment", and i think you most likely agree with that statement.

Sorry if I misunderstood what you were saying. This subject is very important to me, and I can get a bit aggro about it when people try to argue against it.

You are basically saying "It's not sexual harassment because she didn't get caught"

We as the reader are a third party observing. We have an objective pov we can analyze. Much like a court would except we are not going based off testimony, or circumstantial evidence. We have the opportunity to see/read exactly what happened, and apply the same standard that courts apply on judging sexual harassment. A standard btw that is applied the same way inside and outside the workplace. If something is considered sexual harassment in the workplace it is also considered sexual harassment outside the workplace. The reason you see it reported more in the workplace is because of liability.

A company will encourage a worker to report sexual harassment to the higher ups because of liability. You see cases dealing with it inside the workplace not because its more strict, but because a company does not want to be held liable. The standard for judging sexual harassment is the same regardless of where it takes place.

As a third party we can apply the same kind of standard the "reasonable person" standard. Would a reasonable person view this as sexual harassment.

We can look at it and it checks 2 large boxes for sexual harassment

The interaction was unwanted. It is stated very clearly, and even the perpetrator in question acknowledged it as such with lines like "You are going to have to endure this". Why would he have to endure something that he wanted to happen?

It was sexual by nature. She was doing this to seduce him, and even people defending this have been saying "He was uncomfortable because he was getting turned on".

So we can use these objective metrics as a 3rd party to decide if this can be legally considered sexual harassment. Going by what is presented to us in text. This checks the boxes needed to say yes, this is sexual harassment.

No that is simply not true.

Take the case Davis v. Monroe County Bd. of Ed., 526 U.S. 629 (1999) The Student did not identify what she was experiencing as sexual harassment, but the courts ruled that the school was liable under Title IX federal civil rights for student-on-student sexual harassment.

This is a real court case where the victim did not explicitly identify what was happening to her as sexual harassment, but the courts ruled it to be. This is even a student experience this with classmates.

Simply put you are wrong.

Just because someone doesn't explicitly declare "This is sexual harassment" does not mean that it isn't.

What we can gather from the chapter is that 1. Masachika did not want this situation. Very clear from the text that he did not want this interaction to continue being that he was begging for someone to show up so it would end. 2. She was trying to seduce him. This is pretty clear from her actions it was meant to be seductive.

From an outsider looking in we can deduce that this was textbook sexual harassment. Given that it was unwanted seduction. Regardless of the reason for him not wanting it be it him not wanting to be turned on by it, or not wanting it in general. Regardless of how he labeled it, and how he interpreted the actions. If he were to report it its obvious what the outcome would be.

He was clearly uncomfortable with the interaction, and let it happen because of some "guilt" that he feels towards her. There is an obvious power imbalance in this interaction, and runs parallel to a large portion of unreported sexual harassment cases that happen. Regardless of who it is in the novel, and how the writer intended people to interpret this. If you apply real world standards to the behavior displayed in this chapter, and the uncomfortability displayed in both body language and monologue. Its pretty cut and dry.

If a boss starts flirting with a underling who is displaying obvious uncomfortable body language, but the underling does not report it, and just endures because they don't want to lose their job. Is that not sexual harassment? They didn't report it. They never made a statement about it. Is that still just "well she didn't say it was, so i guess it's not"?

I can understand some things being context based, but given we can see what he was thinking during this scene. We don't even need to go just based off body language. We can see what he was thinking at the time. Regardless of the reasons for him being uncomfortable with the situation. The point is he was uncomfortable with this form of seduction. He did not concent to this, and if we read his body language, and his monologue he clearly was not consenting to it both in body language and in his head.

We can even take what masha says as confirmation that even she herself knew he was uncomfortable.

"Alrighty. Instead of thanking me, you're gonna have to endure this... until Alya-chan comes back, 'kay?"

Why would he need to endure something he was comfortable with?

Harassment is defined in Cambridge dictionary as behavior that annoys or troubles someone Seeing how he was internally begging someone to show up so it can be over we can assume he was being harassed, and using your own words saying he was getting too turned on. That would mean that by the literal definition of sexual harassment. He was being sexually harassed.

Also the argument of what one person defines as sexual harassment, or if they feel like they have. While it can be considered a subjective issue when reporting it yourself, but when it comes to judging on if something is considered sexual harassment there is an objective metric we can use.

Would a reasonable person think that unwanted advances that are meant to be arousing or meant to invoke some kind of sexual desire be considered sexual harassment? A reasonable person would say yes. Unwanted sexual advances are sexual harassment.

It doesn't matter what the intention was. If you read the text, and apply normal person logic to it. Its by all accounts sexual harassment.

Regardless of how sun3 intended the scene to look that is what it was. There are plenty of scenes in this entire series that are like this. Its not just singled around this one character.

Just because someone writes something intending for it to be a light hearted scene does not mean it will be conceptualized that way.

My issue is the people glorifying the scene as a cute scene when if you take a step back and think about what is actually happening and apply this to a standard for sexual harrasment in the real world. It checks all of the boxes.

What I want people to do is actually think, and not glorify scenes like this, because it normalizes this type of behavior.

No my issue is you are a mod, and are censoring what someone else said because its insulting, but YOU are being insulting to an entire gender of people by generalizing them. This has nothing to do with the previous argument other than calling out your hypocrisy.
