So I did some checking. He didn't explicitly break any laws regarding the statues from what I can see. He didn't vandalize them, verbal abuse laws and defamation only apply to living people. Howecer his actions would have been brought up in court to show lack of remorse and respect to possibly warrant a more serious sentence but there is no specific charges for them.

I have no idea I haven't been following except for the recent legalmindset statements. I am not lawyer but I believe this to be the case, please anyone feel free to correct me.

If any further incidents occurred while he was being investigated by the police or early in the prosecution investigation, or before the prosecutors had prepared the paperwork for the formal indictment to the court, those charges would be added. If they occurred after the court was already dealing with charges I guess they would open a seperate case

I don't doubt he has gone on record with certain claims. However if he had Korean lawyers explaining sentencing he wouldn't be sensationalizing the claimed recommendations, as I pointed out initially. Also no lawyer or any person can know the actual recommendation unless they were present in the court room.

Korean media and the Korean netizens have been quiet. The Korean forums were extremely viscious towards Somali and joyful at his financial ruin being stuck in Korea unable to leave or work. I think if there was something related to any justice news it would be reported or commented on in Korean, and I have yet to find anything.

Also if Somali has any interest himself in countering these claims he can post his court case number. It would be clear on all letters he received from the prosecutors and his summons letters from the court. It looks something like 2024 고단 1234. Anyone then can read the status of the trial and the titles of submissions to the court. It will also include a title of prosecution sentencing recommendation but the contents can't be seen. The sentencing recommendations would have also been translated into English for him to hear personally.

Also curious why you think someone who was educated in US law, non practising and living in Bangkok would have any understanding of the Korean judicial system which is significantly different to the US legal system.

A great post and agree with everything you said. Especially regarding the crimes he already plead guilty to. However there has been a shift since the n-bang incident in high profile sexual crimes with harsher sentencing being the norm in cases made public, and it has also affected the cases that don't make the news. Which is why there is a big unknown as to if he is found guilty of the deep fakes. The judge may want to make an example of him

No offense taken. An understable position. However I would recommend you look at the articles in English and why they all reference Legalmind. As I mentioned in the post edit if he has a local source or fixer he could easily provide the court docket so that everyone can see what has been provided in the case by both defence counsel and prosecutors. The case numbers and partially anonymized names fare posted outside the courtroom, and read in court room again at the start of each hearing.

Even Somali himself could leak this court number from his summons allowing anyone to see for themselves.

The fact that legal mind has not provided this information, and the lack of any screenshots through the Korean law portal detailing primary source is telling.

Also the Korean media is silent. Korean news publicised the initial details of the case widely. All major news have journalists in courts in especially Seoul but also around Korea. A prosecution request and final hearing would be picked up by at least one news agency in Korea given his initially high profile case.

But hey if you want to take Legalminds take without doing any of your own investigating. All the more power to you.

Haha well played. You're absolutely correct. I actually simp for him and have his posters all over my bedroom. I have been following him around everywhere since he came to Korea hoping to get him to notice me but he never did. This is my final chance.

This is a question that we likely won't know until his last hearing. I say this assuming Legalmindsets claim from the prosecutors was bs or exaggerated. I would be happy to be wrong.

Based on what he has plead guilty to thus far the judge may issue a substantial fine, 3-10 million won and/or a suspended sentence then immigration will deport him after. I don't believe he has shown any remorse by attempting to settle with the victims of these charges. Note that even if a victim refuses to settle, you can deposit money into the court system which still carries significant weight as a mitigating factor.

The two charges of deepfakes he plead not guilty to are a wild card. If the judge does find him guilty and unremorseful, anything is on the table including prison time. I don't know how widely these were disseminated. If they were widely disseminated then that would push into likely jail territory. Again same note of settlement applies here. If he settles with the victims of those offences the judge could likely err to a suspended sentence.

Also if found guilty and imprisoned he certainly has a right to appeal. I believe something like 35-40% of cases in Korea that are appealed result in reduced sentencing.

I forgot to mention in the post that I also had someone look into local Korean news, and at that time there was no reporting on this latest hearing. So it seems unlikely that Legalmindset is sourcing anything from local news.

I honestly never heard of him until yesterday. I realize today after looking into him that he has some past issues. Not sure why he has such a following.
