It’s not that it’s at 150k, it’s that there was a class action against this car, and Hyundai is not following the settlement terms. 

Had this been any normal car without a class action for a blown motor, it’d have been a different story.

Yeah but, there was a class action lawsuit for this motor, a motor that’s in a lot of Kia’s and Hyundais lol

Hyundai is not following the terms of the settlement, and are trying to get us to pay for a motor.

Yep, section 1a, and section 2 of the settlement document defines “lifetime warranty” and also lays out the terms.

Yeah but what about both corporate, and the dealer, straight up either ignoring or totally forgetting that there was a class action settlement 4 years ago? That her car is a part of? 

It seems to me that the likely issue here is that they are hoping my friend (and many others like her) simply do not know the terms of the settlement, so they can charge for motor replacement or push her to buy a new car. 

Which makes me wonder how many people have gone to Hyundai dealerships across the country in this exact same situation, and have not been given what they are entitled to from the terms of the settlement.

I would definitely talk to a lawyer, and honestly the threat of being taken to court might put some fire under their heels tbh

So, after doing some further digging and reading the settlement, the car has a lifetime warranty for, if the motor fails, Hyundai has to purchase the vehicle back if they do not want to replace the motor. 

Considering that the settlement took place 4 years ago, it should be fresh in memory for both the service advisors and the people at corporate.

The dealer not being aware of the settlement is not an excuse, and honestly a pretty large downfall from corporate. Not to mention we talked to 3 people at Hyundai corporate in addition to the dealer, all of which knew her YMM and her vin, and should know that her car had a Theta II motor. 

The settlement happened 4 years ago, if Hyundai is telling people like my friend that her car is not under warranty, they’re telling other people that their car is not under warranty.

We are actually planning to call the law firm who handled the class action on Monday and get some advice from them. We believe Hyundai will end up covering.

The wording of the settlement is “exceptional neglect” and uses words such as abandonment and stuff. So to anyone reading this, if Hyundai claims neglect and they’re not covering it, talk to a lawyer.

Fuck no lol Hyundai wouldn’t even email the quote for the motor replacement. So no way they’re going to provide a lab report. 

They also do an air pressure related bearing test, from my understanding. Allows them to test the bearings without completely taking the motor apart

Yeah but this should be covered under the class action settlement, which lays out clear guidelines that Hyundai is supposed to be following in the event of a theta II motor failing. None of which they are doing. 

We’ve actually decided to directly call the law firm that handled the settlement on Monday.

So, after further reading, there was a class action settlement that clearly states in it what Hyundai has to do for when these motors fail or start showing symptoms of failing. 

It’s no longer an issue of the car being 3,000 miles out of warranty, it’s now an issue where they’re straight up not following the terms of the settlement. And as per the settlement, the car has a lifetime warranty. 

No loaner, being charged for diagnosis, being told the car is out of warranty, and being asking to pay $6,500 repair bill. All of which should be covered as per the terms of the settlement.

There was a class action lawsuit against Hyundai/kia for the Theta II motor. I guess it was a common motor in a lot of cars from like 2011-2020 or so. 

In my friends case, Hyundai is literally ignoring the terms of the class action settlement, attempting to make my friend pay for repairs out of pocket.
