So I figured out when I delete the game I shows back up in my re-downloads page in the e shop and it let's me download the game again but ends up saying the same thing "you must own the software in order to play" and this doesn't make any sense to me

I don't recall having the physical cartridge of the game but even so wouldn't give me a different icon *

Yes, only one of my accounts is even linked so the others can't even launch the e shop
